<br />sale, lease, sublease, transfer, use, occupancy, tenure, or <br />enjoyment of the premises herein conveyed or leased, nor shall the <br />transferee or any person claiming under or through it, establish or <br />permit any such practice or practices of discrimination or <br />segregation with reference to the selection, location, number, use, <br />or occupancy, of tenants, lessees, sublessees, subtenants, or <br />vendees of the premises herein transferred." The foregoing <br />provision shall be binding upon and shall obligate the contracting <br />party or parties and any subcontracting party or parties, or other <br />transferees under the instrument. <br /> <br />Section 4.05. Affordability Covenants. The Declaration <br />of Affordability Covenants which shall be recorded against the <br />Property shall contain covenants which shall require the Project to <br />be used for affordable housing for persons with extremely low to <br />very low, with one manager's unit affordable to persons with the <br />income specified in Section 4.01 of the Agreement. Following the <br />date a Certificate of Completion is issued for the Project and <br />continuing throughout the term of the Affordability Covenants, the <br />Developer shall annually file with the Agency complete and accurate <br />reporting forms for the Agency's review demonstrating compliance <br />with the Affordability Covenants. Such forms shall be provided by <br />the Agency. <br /> <br />Section 4.06. Nondiscrimination and Related Covenants <br />Reauired by Federal Law. The Developer agrees that the covenants <br />set forth in this Section 4.06 shall bind it, for itself and its <br />successors and assigns, and all subsequent holders of any interest <br />in the Property. The federally required covenants set forth in <br />this Section 4.06 shall be covenants running with the land and <br />shall consist of the following: <br /> <br />a. <br /> <br />Section 504 of the Rehabilitation Act of 1973 <br /> <br />(1) Pursuant to Section 514 (Public Law 93-112), to the <br />extent not otherwise exempted by applicable law, the Developer <br />agrees that no otherwise qualified persons with disabilities shall, <br />solely by reason of a disability, be excluded from the <br />participation in, be denied benefits of, or be subjected to <br />discrimination in the performance of this contract or in the <br />selection of low income owners to purchase the dwelling to be built <br />on the Property. <br /> <br />(2) Compliance of Section 504 of the Rehabilitation Act <br />of 1973, as amended, requires that all benefits, aids and services <br />are made available to persons with disabilities on an equivalent <br />basis with those received by non-disabled persons.
