sale, lease, sublease, transfer, use, occupancy, tenure, or enjoyment of the premises herein conveyed or leased, nor shall the transferee or any person claiming under or through it, establish or permit any such practice or practices of discrimination or segregation with reference to the selection, location, number, use, or occupancy, of tenants, lessees, sublessees, subtenants, or vendees of the premises herein transferred." The foregoing provision shall be binding upon and shall obligate the contracting party or parties and any subcontracting party or parties, or other transferees under the instrument. Section 4.05. Affordability Covenants. The Declaration of Affordability Covenants which shall be recorded against the Property shall contain covenants which shall require the Project to be used for affordable housing for persons with extremely low to very low, with one manager's unit affordable to persons with the income specified in Section 4.01 of the Agreement. Following the date a Certificate of Completion is issued for the Project and continuing throughout the term of the Affordability Covenants, the Developer shall annually file with the Agency complete and accurate reporting forms for the Agency's review demonstrating compliance with the Affordability Covenants. Such forms shall be provided by the Agency. Section 4.06. Nondiscrimination and Related Covenants Reauired by Federal Law. The Developer agrees that the covenants set forth in this Section 4.06 shall bind it, for itself and its successors and assigns, and all subsequent holders of any interest in the Property. The federally required covenants set forth in this Section 4.06 shall be covenants running with the land and shall consist of the following: a. Section 504 of the Rehabilitation Act of 1973 (1) Pursuant to Section 514 (Public Law 93-112), to the extent not otherwise exempted by applicable law, the Developer agrees that no otherwise qualified persons with disabilities shall, solely by reason of a disability, be excluded from the participation in, be denied benefits of, or be subjected to discrimination in the performance of this contract or in the selection of low income owners to purchase the dwelling to be built on the Property. (2) Compliance of Section 504 of the Rehabilitation Act of 1973, as amended, requires that all benefits, aids and services are made available to persons with disabilities on an equivalent basis with those received by non-disabled persons.
