<br />3. Marketinq of HOME Units. The Developer shall comply <br />with the City's affirmative marketing plan for the HOME Units to be <br />provided by City. Except for existing tenants, the Developer <br />shall, to the extent permitted by applicable law, select eligible <br />tenants for the Home Units from a pool of applicants residing in <br />the incorporated limits of the City of Redwood City no later than <br />the date on which construction will begin or the earliest date unit <br />is habitable for occupancy. The Developer shall include as part of <br />its marketing efforts: <br /> <br />(i) outreach to homeless and at-risk of being <br />homeless households transitioning through one of <br />the various homeless and self sufficiency <br />assistance programs operating in the City of <br />Redwood City <br /> <br />(ii) provide notice of vacancies or opening of <br />waiting lists to Fair Oaks Community Center, a CORE <br />Referral agency for San Mateo County Human Services <br />operation <br /> <br />The City shall be responsible for providing the Developer <br />with a pool of qualified applicants to fill the HOME Units. <br /> <br />(c) The foregoing covenants shall not be deemed to <br />supersede any affordability covenants against the Property which <br />require that the units of the Property be made available to persons <br />of lower income levels than provided herein, but shall apply if <br />there are no covenants which are more restrictive which apply to <br />the Property. <br /> <br />4. Lobbyinq Prohibited. The Developer shall not use <br />HOME funds for publicity or propaganda purposes designed to support <br />or defeat legislation pending before federal, state, or local <br />government. HOME funds shall not be used by Developer to influence <br />an officer or employee of any agency, a Member of Congress, and <br />officer or employee of Congress, or an employee of a Member of <br />Congress in connection with the award of any Federal contract. <br /> <br />5. Maintenance of Property. During such time as the <br />Affordability Covenants set forth in Section 2 of this Declaration <br />are in effect, the Property shall at all times be maintained a <br />rental apartment complex of not less than fifty eight (58) units. <br />The Property shall at all times be maintained in a neat and orderly <br />condition consistent with good management practices and in <br />accordance with all applicable Federal, State and local laws. <br /> <br />E - 5 <br /> <br />REDW\0006\DOC\001-5 <br />1/27/05 7:00 /mve <br />
