s�-i <br /> REPORT <br /> To the Honorable Mayor and City Council <br /> From the City Manager <br /> EXECUTIVE SUMMARY <br /> March 14, 2005 <br /> Subject <br /> Adoption of a Resolution Confirming City Council Policy with respect to development on <br /> Laurel Way <br /> Recommendation <br /> That the City Council adopt the attached resolution confirming their policy with respect to <br /> the development of vacant sites on Laurel Way as follows: <br /> 1. Determine that the December 18, 2000 staff report and Exhibit A to Resolution 14111 <br /> (a map) accurately represent the Council's policy with respect to the location of the "EIR <br /> — No EIR Line;" <br /> 2. Adopt the attached Resolution which specifies Council's policy as it is presented in the <br /> December 18, 2000 staff report and Exhibit A with respect to development of vacant <br /> parcels on Laurel Way and the location of the "EIR — No EIR Line." <br /> Issue <br /> Existing City Council policy, established in 1988 and modified in 2000, states that no <br /> further development should occur on parcels on the west end of Laurel Way until an <br /> Environmental Impact Report (EIR) is prepared for all of the undeveloped portion of Laurel <br /> Way. Recently, Mr. Scott Sweeney, the property owner of 3730 Laurel Way (a vacant lot), <br /> has made staff aware of a need for clarification befinreen the Staff Report from December <br /> 18, 2000 and the associated Resolution. Both documents describe the location of the "EIR <br /> — No EIR Line," but use different references. <br /> Major Findings <br /> ■ December 18, 2000 Staff Report: The staff report clearly describes the location of the <br /> line with respect to 3726 Laurel Way, the "Last House" on the north side of the street. <br /> "All other vacant parcels along Laurel Way that are located westerly of 3726 Laurel <br /> Way would have to comply with the requirement that an EIR and technical studies <br /> (geographical, engineering, etc.) covering the entire undeveloped area be prepared <br /> priot to any development..." <br /> ■ Reso/ution 14111: The resolution does not specify the location of the EIR — No EIR <br /> Line based on addresses or parcels numbers for any of the prop�erties. The Resolution <br /> refers to Exhibit A, which depicts the location of the line as described below. <br /> ■ Exhibit A— Map: The EIR — No EIR Line shown on the map as an exhibit to the <br /> Resolution clearly matches the description of the location of the line in the December <br /> 18, 2000 staff report with the line located along the west side of the "Last House" at <br /> 3726 Laurel Way. <br />
