�.A -� <br /> REP�RT <br /> To the Honorable Mayor and City Council <br /> From the City Manager <br /> March 14, 2005 <br /> Subject <br /> Adoption of a Resolution Confirming City Council Policy with respect to development on <br /> Laurel Way <br /> Recommendation <br /> That the City Council adopt the attached resolution confirming their policy with respect to <br /> the development of vacant sites on Laurel Way as follows: <br /> 1. Determine that the December 18, 2000 staff report and Exhibit A to Resolution 14111 <br /> (a map) accurately represent the Council's policy with respect to the location of the "EIR <br /> — No EIR Line;" <br /> 2. Adopt the attached Resolution which specifies Council's policy as it is presented in the <br /> December 18, 2000 staff report and Exhibit A with respect to development of vacant <br /> parcels on Laurel Way and the location of the "EIR — No EIR Line." <br /> Background <br /> Laurel Way is a private street located on the north side of a steeply sloping hill within the <br /> Emerald Hills neighborhood planning area. Utilities are not readily available to many <br /> parcels fronting on Laurel Way and emergency access is significantly substandard along <br /> this street, except at the eastern end where the roadway is improved to City standards. <br /> About half of the parcels fronting on Laurel Way remain vacant. In general, these lots have <br /> significant slopes, may contain unstable soils, and are blanketed with native vegetation and <br /> habitat. The Laurel Way roadway includes three surface conditions: improved to City <br /> standards at the east end; paved but significantly substandard and narrow in the center <br /> section; and unpaved and severely substandard for the entire western end. <br /> . Existing City Council policy, established in 1988 and modified in 2000, states that no <br /> further development should occur on parcels on the west end of the street until an <br /> Environmental Impact Report (EIR) is prepared for all of the undeveloped portion of Laurel <br /> Way. It was determined that the cumulative impacts of development in this area would be <br /> very significant. The 1988 policy affected all of the vacant parcels with frontage on Laurel <br /> Way. On December 18, 2000, a line was established by Council which specified which <br /> parcels would require an EIR for development and which would not. This line will be <br /> referred to throughout this report as the "EIR — No EIR Line." Development of properties on <br /> the EIR side of the line will require a comprehensive street and utilities improvement plan <br /> for all of Laurel Way as well as geotechnical and biotic studies. A map of Laurel Way <br /> indicating the remaining vacant properties and the location of the EIR — No EIR Line is <br /> provided following for reference. <br /> In 2000, City Council established the EIR — No EIR Line at the "last house" on the northern <br /> side of the street. Thus, since the property at 3726 Laurel Way is the furthest west property <br /> on the north side of the street that has been developed, parcels furtherwest of 3726 are on <br />
