   w V
the EIR side of the line, otherwise referred to as the "Affected Area," and parcels east of
3726 are on the No IR side of the line. Recently, the property owner of 3730 Laurel Way
(a vacant lot), has made staff aware of a need for clarification between the Staff Report
from December 18, 2000 and the associated Resolution. Both documents describe the
location of the EIR — No EIR line, but use different references. Staff has met with the
property owner and there was a subsequent exchange of written correspondence befinreen
the property owner and the City, which is provided in Attachment 1. The property owner
believes that his property, which is located immediately west of 3726 Laurel Way and is
thus in the "Affected Area," should not be subject to the EIR requirement since there is
paving (which is significantly substandard) in front of his property as well as the presence
of a water and sewer line in the street. 3730 Laurel Way is located on the EIR side of the
line as indicated in the map below, since this property is west of the transition point
established by the location of the "Last House."
"AFFECTED AREA" _ EIR — No EIR Line" Parcels east of
Parcels west of the the line do not
line require an EIR '' ' z"Last"' require an EIR

' House ^
. M
t* M ta c
` 691 ; c, sS
   m c '
r- r. °j M

. v' rr 62
L,p•R w; M g o c x
 . . " M M '
 ^
N a '
  00 , Shaded Parcels
      y , Are Vacant 2 ,
*"Last House" = The furthest west developed property on the north side of the street.
The determination that the Last House would specify the location af the line is based on the
following considerations which include significant geologic concerns that have been
observed in the Affected Area:
■ Soil creepage and several subsurFace water seepage zones must be evaluated
comprehensively.
■ Roadway cracking possibly indicating downslope movement must be further
investigated and understood.
■ Pooled water on the roadway and other evidence of groundwater seepage also requires
additional study.
■ Landslide risk due to the above noted geologic factors and the steep terrain within the
context of the seismically active Bay Area must be fully assessed.
■ Surface drainage and soil stability needs to be assessed for existing and future
development as a whole.
