��A� <br /> ■ Public facilities/utilities must be designed for the entire future system. <br /> ■ Street improvements must provide for adequate emergency vehicle access as well as <br /> for the maintenance and repair of utilities within the Affected Area <br /> ■ Street improvements require significant retaining wall systems within the Affected Area <br /> The issues listed above were included in the findings for the resolution in 2000. These are <br /> clearly serious concerns. The resolution also stated that development of any individual <br /> parcel could result in cumulative impacts with respect to the above issues and thus must <br /> be considered comprehensively in the context of the probability of future development <br /> within the Affected Area. <br /> The property owner of 3730 Laurel Way, Mr. Scott Sweeney, has informed the City that he <br /> believes that the resolution language implies that any property with frontage on any paved <br /> portion of Laurel Way, either to City standards, or substandard as is the case with his <br /> property, can be developed without an EIR (see Attachment 1). Staff disagrees with this <br /> interpretation based on the specific information in the 2000 staff report and the map, <br /> Exhibit A, which clearly shows the EIR — No EIR Line immediately west of the Last House <br /> at 3726 Laurel Way. 3730 Laurel Way is a steeply sloped property (approximate average <br /> slope is 36% with portions greater than 45% slope in the proposed building pad area); <br /> covered with native vegetation; and subject to other potential development challenges that <br /> should be fully assessed in context with the build-out of Laurel Way as required by Council <br /> policy. In response to the property owner's assertion that his property at 3730 Laurel Way <br /> should be exempt from the EIR requirement, staff determined that this matter should be <br /> brought back to Council for confirmation of the location of the EIR — No EIR Line as shown <br /> on the map. <br /> The following three documents present the EIR — No EIR Line as follows: <br /> ■ December 18. 2000 Staff Report: The staff report clearly describes the location of the <br /> line. It very specifically indicates that only two vacant parcels (3718 and 3724 Laurel <br /> Way as shown on the map above) would be on the side of the line not requiring an EIR. <br /> (A third vacant parcel west of 3717 would also qualify; however, it is under the same <br /> ownership as 3717 which functions as a"double-IoY' property.) The first page of the <br /> staff report states that "development may occur on these finro parcels without <br /> preparation of an EIR and related studies, and not on any vacant parcels along Laurel <br /> Way beyond the improved lot at 3726 Laurel Way." The staff report repeats this <br /> determination several more times, for example, this statement is included on page 2: <br /> AI! other vacant parcels along Laurel Way that are located westerly of 3726 Laurel <br /> Way would have to comply with the requirement that an EIR and technical studies <br /> (geographical, engineering, etc.) covering the entire undeveloped area be prepared <br /> prior to any development..." <br /> ■ Resolution 14111: The resolution does not specify the location of the EIR — No EIR <br /> Line based on addresses or parcels numbers for any of the properties. Rather, it refers <br /> generally to pavement conditions which vary significantly on the street. The Resolution <br /> does refer to Exhibit A, which depicts the location of the line as described below. <br /> ■ Exhibit A— Map: The EIR — No EIR Line shown on the map, as an exhibit to the <br /> Resolution clearly matches the description of the location of the line in the December <br />
