g A <br /> / <br /> 18, 2000 staff report with the line located along the west side of the "last house" at 3726 <br /> Laurel Way. <br /> Since December 2000, Planning Services has consistently used the map in Attachment A <br /> for counter handouts to inform the public about development regulations on Laurel Way. At <br /> the meeting on December 18, 2000 the staff presentatior�, public hearing, and Council <br /> discussion were referenced to the staff report. A PowerPoint presentation was also shown <br /> that included the map used for Attachment A in the resolution. Staff strongly believes that <br /> Council's intention was for the "EIR — No EIR Line" to be located as shown on that map. <br /> Minutes to the Council meeting of December 18, 2000 are provided in Attachment 5. Staff <br /> believes that the resolution should be amended to clarify the references to paving and that <br /> the resolution should also specify the location of the line with respect to the "Last House" at <br /> 3726 Laurel Way, as proposed in Attachment 6. A little over a year later, Mr. Sweeney met <br /> with Bruce Liedstrand and Joel Patterson to discuss the development of 3730 Laurel Way. <br /> Again, the Council policy was discussed and clearly stated to Mr. Sweeney. <br /> This decision would be consistent with City Council's recent decision on another property <br /> on Laurel Way. The Council has considered this policy with respect to another property <br /> within the Affected Area, on the EIR side of the line, in December 2003. The property <br /> owner of 3738 Laurel Way sought to develop that lot with a single family home without <br /> preparing an EIR or the other plans and studies. 3738 Laurel Way's frontage includes both <br /> an unpaved portion and a paved, but substandard portion of the street. The Zoning <br /> Administrator denied the Architectural Permit and the property owner appealed to City <br /> Council. The City Council denied the appeal, which supports the policy that the intended <br /> location for the EIR — No EIR Line is as shown on the above map. <br /> Alternatives <br /> 1. Maintain the EIR — No EIR Line as it was shown in Attachment A to the 2000 <br /> Resolution. <br /> 2. Eliminate the EIR — No EIR Line and thus require that all vacant properties on Laurel <br /> Way are together subject to an EIR review prior to development, similar to the original <br /> . policy for Laurel Way established in 1988. <br /> 3. Determine that the location of the EIR — No EIR Line should be moved to some other <br /> location, such as at the termination of utilities (sewer and water) at 3737 Laurel Way. <br /> For this example, three more parcels (3730, 3734, and 3738 Laurel Way) would be on <br /> the "No EIR" side of the line. <br /> Fiscal Impact <br /> There will be no change in fiscal impact if Council confirms the policy as it has been <br /> administered. <br /> Conclusion <br /> Maintaining existing Council policy includes retaining the location of the "EIR — No EIR <br /> Line" immediately west of the last house at 3726 Laurel Way as shown in Attachment A to <br /> the 2000 Resolution. Staff has consistently communicated this policy to interested parties <br /> since it was adopted in December 2000. Existing Council policy does not preclude <br /> development; complies with CEQA; and insures the City, the adjacent hillside residents, <br />
