. - - .-.
,-17
Page 2 October 12, 2004
because such development arrd improvement of Laurel R'ay would require eztensive
grading and the construction of retaining walls pursuant to the Improvement
Plans; further, water arul sewer utilities are not currently available to said
properties. "
My lot at 3730 fronts on the said paved portion of Laurel Way, and does not require for
development the construction of water and sewer lines, nor does it require extensive
grading and the construction of retaining walls pursuant to the Improvement Plans. In
addition, I have a properly designed, constructed and approved storm water drainage
system on my property (see pictures) that was signed off by John Lynch in engineering,
that further distinguishes my property from (the "Affected Area'. I've enclosed pictures,
drainage agreement, and as-built drawings for your review.
I've met with staff members Tom Passanisi and Jill Ekas to discuss this, and their response
was that they went by the staff report and not the Resolution when drawing the Exhibit
"A". It is this behavior that explains the discrepancy. It was my contention that the
Resolution is Policy and would take precedent over the staff report? Staff would not
acknowledge the Resolution, even Paragraph "1" as I read it before them in their office.
Tom Passanisi did not even acknowledge a 1996 Parcel Map which he gave me 8 years
ago (enclosed) showing the paved section and dirt road.
I've spoken with Vice Mayor Barbara Pierce and Forner Mayor and Council Member Jim
Hartnett for guidance, henceforth this letter. I'd 11ce to resolve this, and would appreciate
it if you can look into this and get back to me in the next couple of weeks, hopefully .
before the next October 25th Council Meeting. I will be happy to speak in front of the
Council if neces.sary. If you have any questions, please feel free to contact me at (650)
430-4131.
, Sincerely,
.i
/ ,,'
 Gct-C.Eit..(ti
Scott Sweeney
Enclosures:
Resolution #14111, 1996 Parcel Map, drainage agreement, as-built drawings, tot pictures,
and storm drain pictures.
