<br /> Contract Terms
<br /> The contract extension is for two years, through June 30, 2008. There is no termination
<br /> clause aside from breach of contract for PHS, the County, or any city. In the previous
<br /> contract either party could terminate with 90 days notice. This exposed the County and
<br /> Cities to substantial impact if the contractor were to terminate. We could not set up an
<br /> effective animal control field services program in 90 days. This two year contract extension
<br /> continues to lock us into mandatory 5% increases between fiscal years, less the $732,510
<br /> in contract savings over the five-year term PHS has agreed to.
<br /> The contract extension contains an incentive for PHS to efficiently use funds and not spend
<br /> 100% of the contract amount. PHS and the Cities/County will equally share any contract
<br /> savings. The total cost of the countywide contract for 2004-2005 is $4,424,617, and the
<br /> cost for the City of Redwood City is $460,996.
<br /> City staff has explored several options prior to entering the original contract, so as not to
<br /> have to enter into this agreement, including extensive discussions with Palo Alto Animal
<br /> Control Services to see if they could provide the services for Redwood City. Staff also has
<br /> explored working with a private kennel to provide a large portion of the care and sheltering
<br /> requirements, which are a very costly portion of the agreement. However we were not able
<br /> to find a kennel willing to provide these services.
<br /> Alternative
<br /> There is no reasonable alternative available. Redwood City staff has explored other service
<br /> options in the past. This was done prior to entering into the original contract, through the
<br /> possible use of alternative service providers including the City of Palo Alto and private
<br /> kennels. The City could provide these services by itself, but due to very expensive and
<br /> state mandated rules and regulations, this would not be cost effective to Redwood City.
<br /> State law says a City must pick up stray animals. Once a stray animal (i.e. dog) is picked
<br /> up a whole series of expensive actions mandated by the state are triggered (i.e. keep the
<br /> dog for certain number of days, attempt to find owner, allow visitors, medically treat the dog
<br /> etc. )
<br /> Fiscal Impact
<br /> The Amendment to the PHS contract represents a total savings to the County and cities of
<br /> $732,510 over the five-year contract term, assuming a 5% increase between contract
<br /> years. For FY 2004-05, the PHS contract amount will decrease by $200,000 to
<br /> $4,424,617. The city and County cost distribution formula is updated yearly. This year the
<br /> City's share of costs is 11.93% or $460,996. The FY 2005-06 contract amount is
<br /> $4,703,348, FY 2006-07 is $4,829,745, and FY 2007-08 is $5,076,951.
