10. Report re proposed Nuisance Abatement, dilapidated <br />building - 851 Brewster (market building) (public <br />hearing held 8/26/85) (702 -11) <br />Report of City Manager and Chief Building Official 9/26/85 <br />In response to question, City Attorney Sch ricker noted that at the August 26, <br />1985 meeting, when the public hearing on the subject proposed Nuisance <br />Abatement was held, the proposed resolution failed on a tie roll call vote. <br />He said that if a public nuisance abatement is proposed again, the finding <br />must be something that the courts would support such as factors endangering <br />life, health, public welfare, etc. Mr. Schricker noted that the recurring <br />nature of a nuisance is grounds for support of abatement proceedings which <br />can be reinstituted after inspection and a reasonable review period. <br />M /S: Chandler /Mosher that staff be directed to watch the building at 851 <br />Brewster closely for evidence of further deterioration and possible nuisance <br />abatement and also that a committee be formed of Council representatives and <br />the property owners to explore possible uses of the site. <br />Carried unanimously by voice vote. Report re proposed financing of Transportation Study <br />for Redwood Peninsula (702 -02) <br />Report of Community Development Director to City Manager 10/4/85 <br />Information item. <br />---------------------------------------------------------------------------------- <br />12. Proposed Willow Street Assessment District (407 -04) <br />Report of City Manager 9/30/85 <br />In response to question, Community Development Director Schroeter reported <br />that Daniel and John Beltramo support the assessment district and have done <br />all possible to have it formed, and that he believes they should be permitted <br />to proceed with the parking lot at 520 Willow Street without the condition <br />placed on their Architectural Permit requiring initiation of assessment <br />district proceedings. <br />M /S: Rhodes /Bury to reverse the prior decision to proceed with an assessment <br />district on Willow Street, allow the Beltramo's to proceed with the parking <br />lot for which they have Architectural Permit, and to look for other <br />alternatives with regard to street improvements. <br />John Beltramo, stated that he owns 32% of the frontage and agreed to the <br />proposed assessment district and are willing to pay their portion in cash for <br />the improvements on Willow Street, but they do not believe they should pay <br />for all the needed improvements on the street. <br />The motion carried unanimously by voice vote.
