Item No. 3 (continued)
Community Development Director Schroeter commented and replied to questions
by Council and advised that since adoption of the ordinance prohibiting
outdoor sales, his office has been engaged in enforcement, not only with
respect to the subject case, but with the several others mentioned, also.
M /S: Chandler /Mosher to uphold the decision by the Zoning Administrator to
deny applications of Ho Kyong Song for a Use Permit and Architectural Permit
for outdoor sales of merchandise, 694 E1 Camino Real, and approve the
findings of the Zoning Administrator as follows:
1) that prolonged outdoor sales events have the effect of depressing
property values in the vicinity;
2) established businesses in permanent buildings are placed at a
disadvantage by an outdoor sales enterprise nearby, and the result could
be failed businesses and building vacancies which in turn would depress
property values in the vicinity; and
3) this application is for permanent outdoor sales, rather than for short -
term outdoor sales as a special promotional event, and therefore would be
detrimental and injurious to properties and property values in the
vicinity.
Carried unanimously by voice vote.
MINUTE ORDER NO. 85 -180
---------------------------------------------------------------------------- - - - - --
ORAL COMMUNICATIONS - None
REPORTS OF BOARDS, COMMISSIONS AND COMMITTEES
4.
