c. In the event of claims, causes of action, suits or judgments, for death or injuries <br />tO persons, or loss of or damage to property, alleged to have resuked fi.om a dangerous condition of the <br />property, and/or the maintenance, lack of ma'mtenance or negligent maintenance of the facilities, it shall <br />be presumed that primary liability and responsibility to defend against such claims is that of the party <br />whose officers, employees or agents have created the dangerous condition or were primarily responsib.le <br />for the maintenance of the facilities, the lack of maintenance or negligent maintenance thereof. <br /> <br /> d. In the event of claims, causes of action, suits or judgments, for death or injuries <br /> <br />to persons, or loss of or damage to property, alleged to have resulted fi.om the provision of municipal <br />services, including police, fire, or other services, it shall be presumed that primary liability and <br />responsibility to defend against such claims is that of the party whose officers, employees or agents are <br /> <br />primar'dy responsible for the provision of said services. <br /> 10. Insurance. <br /> <br /> County, City and District shall each maintain public liability insurance or self insurance, generally <br />at levels currently in effect for each agency, insuring against all liability of City, County and District and <br />their authorized representatives aris'rog out of and in connection with this Agreement. <br /> <br /> 11. Administration of Agreement. <br /> <br /> a. The oversight of this project shall be peffomaed by a committee of six persons, <br /> <br />consisting of the Kedwood City Manager, a member of the Redwood City Council, the County of San <br />Mateo County Manager, a member of the County of San Mateo Board of Supervisors, the <br />Superintendent of the Redwood City School District, and a trustee of the Kedwood City School <br />District. The committee shall meet not less often than twice yearly, and shall review, assess and attempt <br />to resolve issues arising from use, maintenance, capital improvements, or payment for the fields and <br />incidental expenses. <br /> <br /> b.
