Item No. 1 (continued) <br />Planning Director Patterson presented an overhead of the site and described <br />the proposed amendment to Condition 7 and the new Condition 10 referred to in <br />the subject report. Mr. Patterson replied to questions concerning the <br />feasibility of a roadway behind the properties fronting East Bayshore, the <br />improvements to traffic a bridge over Redwood Creek would offer, plans and <br />priorities which exist for construction of such a bridge, and the proposed <br />traffic improvements to be constructed at the expense of the applicant. <br />Mayor Claire declared the public hearing open at 8:02 p.m. <br />Mario Biaqi, 1566 Hudson Street, representing Peter Uccelli, the appellant, <br />challenged the peak hour figures on pages 26 and 27 of the BKF study and <br />those for movement of tr aff i c from the left t urn lane into the theatre <br />parking lot. Mr. Biagi also disagreed with the expectation that some 549 of <br />the theatre complex audience would come from the south, suggesting population <br />is heavier north of Redwood City and asked for a critique of the BKF study by <br />the Traffic Engineer. Mr. Biagi urged that the appeal be granted and the Use <br />Permit denied until the traffic problems associated with it are solved. <br />George Corey, Millbrae, attorney representing Syufy Enterprises, presented <br />the subject BKF study, stating that it covers the previously expressed <br />concerns of Council relating to staggering movie times, use of safety <br />equipment on East Bays hore and impact of existing and anticipated build-out <br />in the area. Mr. Corey referred to a copy of the March 4, 1988 letter to him <br />from BCDC regarding the suitability of placing a road at the rear of the <br />subject property and suggesting it is unlikely any such road would be <br />approved . <br />(Council recessed from 8:25 to 8:32 p.m.) <br />Carl McGuire, Traffic Engineer, BKF, presented overheads about which concern <br />has been expressed and commented on the attempt to mitigate problems, using <br />pages 10, 11 , 31 and 34 of the report and an aerial photo. <br />Jack Myhill, General Manager of Syufy Enterprises, referred to the March 4, <br />1988 letter from BCDC and described his methods of determining costs for a <br />rear roadway. Mr. Myhill used a graph to display the one -hour and ten minute <br />spread of movie starting times in the theatres and a map to indicate the <br />source of the prospective audience according to the movie distribution zones <br />used in the industry. <br />In response to question, Mr. Corey said that the applicant is familiar with <br />all of the proposed conditions of the Use Permit and agrees to accept them. <br />He requested that future developers who will benefit from the improvements be <br />required to reimburse his client by paying a proportionate share when they <br />develop. <br />City Attorney Schri cker advised that legal issues are involved with the <br />validity of such a reimbursement agreement, since the courts have held such <br />payments to be assessments which require full assessment hearings. <br />MINUTE BOOK NO. 47 <br />Page No. 521 <br />Reg.Mtg. <br />3/14/88 <br />Page 2 <br />
