Item No. 1 (continued) <br />In response to question, Assistant City Attorney Case said that there being <br />no one present who wished to speak, the public hearing may be continued <br />unopened until a future date, and the appellant who requested the continuance <br />would be required to pay for readvertis ing the public hearing. <br />M /S: Bury /Stangel to continue the subject public hearing until a future <br />date mutually convenient for the appellant and the City Council and that the <br />appellant be required to pay for republishing the Notice of Hearing for the <br />new date. <br />Carried unanimously by voice vote. <br />MINUTE ORDER NO. 85 -20 <br />---------------------------------------------------------------------------------- <br />2. Public Hearing - Proposed vacation of emergency access <br />easement and portion of public street (Heller Street) <br />(Per RESOLUTION NO. 9801, 2/4/85; Report of City <br />Manager 1/31/85) (Z02 -06 ) <br />Affidavits of Publication of Notice of Hearing and of Posting on file. <br />Director of Public Works Addiego referred to the subject report and to <br />transparencies of the area indicating the easement proposed to be vacated and <br />the new easement. Mr. Addiego reported he had met with representatives of <br />the Price Club and of George Solari, the adjacent resident, and all have <br />agreed on the handling of the vacation of easement on Heller Street. <br />Mayor Britschgi declared the public hearing open at 7:45 p.m. <br />Dale Gunderson, Price Club, San Diego, stated that he is in agreement with <br />the statements of Mr. Addiego. He suggested that the new easement is a <br />better alignment than the previous one. <br />Chester Lebsack, 525 Marshall Street, attorney representing George Solari, <br />stated that the arrangements agreed upon in the meeting with Mr. Addiego and <br />representatives of the Price Club and Orchard Supply are satisfactory to his <br />client. <br />Mayor Britschgi invited anyone else present who wished to speak to do so. No <br />one wished to speak. <br />M /S: Bury /Stangel to close the public hearing. <br />Carried unanimously by voice vote and public hearing closed at 7:50 p.m. <br />Title read.
