Item No. 4 (continued) <br />Mayor Britschgi declared the public hearing open at 8:00 p.m. <br />Affidavits of Publication of Notice of Hearing and of Mailing are on file. <br />It was noted that the Notice of Hearing was readvertised following the <br />continuance of the item from the meeting of February 25, 1985. <br />Bill Rosetti, TRI Development Co., Inc., 2530 Baker Street, San Francisco <br />described the background relating to the subject appeal, stating there is a <br />need for a vote among the homeowners of Phase I to allow the Phase II <br />association to join it. Mr. Rosetti said that a vote is being taken during <br />the weekend of March 30 -31, 1985, and asked that the item be continued until <br />after that date. He said that depending upon the outcome of the vote, the <br />appeal may be withdrawn. <br />City Attorney Schricker advised that the City Council has jurisdiction with <br />regard to the requirement of the Planned Development Permit (PDP) that there <br />be one homeowners association, and the homeowners vote is a separate matter <br />between the developer and the associations. <br />Mayor Britschgi invited anyone else present who wished to speak to do so. No <br />one wished to speak. <br />Discussion followed concerning the possible effect of Council action at this <br />time and the absence of representatives of the homeowners association in the <br />audience. <br />M /S: Stangel /Chandler to continue the subject appeal for two weeks with <br />notice of the new public hearing date to be republished and notices mailed at <br />the expense of the appellant. <br />CLARIFICATION AND AMENDMENT TO THE MOTION: In response to question of Mrs. <br />Hildebrand, Councilman Stangel stated that it is the intent of his motion to <br />withhold the new notice until after the homeowners vote and that if the <br />appeal is to be held, the public hearing will be scheduled for April 15, <br />1985, to allow adequate time for publication. <br />Carried unanimously by voice vote. <br />MINUTE ORDER NO. 85 -39 <br />---------------------------------------------------------------------------------- <br />ORAL COMMUNICATIONS <br />None <br />---------------------------------------------------------------------------------- <br />REPORTS OF BOARDS, COMMISSIONS AND COMMITTEES <br />Councilman Chandler reported that the Mobi lehome Owners Rent Stabilization <br />Committee has completed its assignment and its recommendations are scheduled <br />for consideration by Council at the April 22, 1985 meeting.
