Item No. 4 (continued) Mayor Britschgi declared the public hearing open at 8:00 p.m. Affidavits of Publication of Notice of Hearing and of Mailing are on file. It was noted that the Notice of Hearing was readvertised following the continuance of the item from the meeting of February 25, 1985. Bill Rosetti, TRI Development Co., Inc., 2530 Baker Street, San Francisco described the background relating to the subject appeal, stating there is a need for a vote among the homeowners of Phase I to allow the Phase II association to join it. Mr. Rosetti said that a vote is being taken during the weekend of March 30 -31, 1985, and asked that the item be continued until after that date. He said that depending upon the outcome of the vote, the appeal may be withdrawn. City Attorney Schricker advised that the City Council has jurisdiction with regard to the requirement of the Planned Development Permit (PDP) that there be one homeowners association, and the homeowners vote is a separate matter between the developer and the associations. Mayor Britschgi invited anyone else present who wished to speak to do so. No one wished to speak. Discussion followed concerning the possible effect of Council action at this time and the absence of representatives of the homeowners association in the audience. M /S: Stangel /Chandler to continue the subject appeal for two weeks with notice of the new public hearing date to be republished and notices mailed at the expense of the appellant. CLARIFICATION AND AMENDMENT TO THE MOTION: In response to question of Mrs. Hildebrand, Councilman Stangel stated that it is the intent of his motion to withhold the new notice until after the homeowners vote and that if the appeal is to be held, the public hearing will be scheduled for April 15, 1985, to allow adequate time for publication. Carried unanimously by voice vote.
