RESOLUTION NO. 9845 AWARDING SALE OF BONDS. <br />adopted unanimously by roll call vote. <br />(Counc i 1 recessed from 8: 50 to 8: 55 p. m. ) <br />ORAL COMMUNICATIONS <br />1. Geri Mayers, President, Downtown Redwood City Association, read from the <br />Redwood City Downtown Development Plan adopted December 10, 1983, and her <br />letter of April 4, 1985, (copy on file) urging adoption of an emergency <br />ordinance establishing a moratorium on the issuance of business licenses for <br />uses other than retail in locations occupying ground level space in the <br />business area. In response to question, Ms. Mayers acknowledged that her <br />specific concern is that a bingo parlor may be permitted to be operated on <br />Broadway in addition to the game presently at the Fox Theatre to which she <br />also objects. <br />City Manager Smith reported that he understands application has been made for <br />a permit to the Police Department noting that if the operation is within the <br />law, the Police Department will have no alternative but to issue the permit. <br />Assistant City Attorney Beougher advised that a moratorium could be done for <br />45 days with a 45 -day renewal period with 4 /5ths Council vote, but noted that <br />exigent circumstances must exist for an emergency ordinance. Mr. Beougher <br />pointed out that the use permit application procedure before the Zoning <br />Administrator is an appropriate means of handling the matter. <br />Mario Biagi, 900 Veterans Boulevard, offered support to the Downtown <br />Association and suggested that the business license approach is not <br />appropriate, but asked Council to direct attention to Sections 14.4 and <br />14.4(b) of the Zoning Ordinance, suggesting a moratorium on just bingo parlor <br />use is possible. Mr. Biagi recommended a 90 -day moratorium; that during the <br />moratorium the bingo ordinance be changed so that prospective operators must <br />have been in business in the city for at least five years with their role <br />with regard to community contributions to be considered; that the block where <br />bingo is proposed be added to the Centre Redevelopment Subarea; and that the <br />license to conduct bingo games at the Fox Theatre be cancelled. <br />Mr. Smith said that if the Fox Theatre operation received the license in <br />error, the matter can be investigated and corrected. <br />Willy Ostertaq, 3104 Cananea, Burlingame, developer of 850 Main Street, <br />observed that recent Council action has been to encourage upgrading of the <br />downtown area and suggested that bingo parlors create a bad image and bring <br />in an undesirable element.
