Item No. 1 (continued)
Yolanda Gomez, owner of Los Pericos, 2730 Broadway, described her restaurant
and reviewed her application. She indicated that she had approached the high
school's PTSA, and the clergy, and that the reaction was positive. She
advised in response to question by Council that she had waited ten months to
pursue her appeal so that she could discuss the application with the school.
In further response to questions, she stated that the reason there is so much
take -out trade at her restaurant is that beer and wine are not available
there; that she would rather serve customers on the premises and believes
they would be more likely to stay if beer and wine could be served with the
meal.
Hillary Spence, 327 Hudson, with Town Mailer of Redwood City, supported the
appeal and did not believe the high school students would be influenced by
the availability of wine and beer at the restaurant.
Mayor Britschgi invited anyone else present who wished to speak to do so. No
one wished to speak.
M /S: Bury /Stangel to close the public hearing.
Carried unanimously by voice vote and public hearing closed at 8:30 p.m.
M /S: Claire /Chandler to deny the appeal of Joseph E. Bergeron on behalf of
Yolanda Gomez and uphold the decision of the Zoning Administrator to deny
application for a Use Permit to sell beer and wine in an existing restaurant,
2730 Broadway, based upon the following findings:
That granting of the Use Permit would be injurious to the property or
improvements of the neighborhood and to the general welfare of the City
as follows:
1. That to the extent sales overall would be increased by use of on -site
consumption of alcoholic beverages, the parking situation in the area
would be exacerbated in connection with use of the property, and
would be contrary to the variance which has heretofore been granted
for the parking;
2. the sale of alcoholic beverages would have a cumulative negative
effect on the overall neighborhood and use of the property;
3. that granting of the Use Permit would not promote orderly development
of the Downtown Business District as the central shopping facility in
accordance with the policy of the CG Zoning District;
4. that the granting of the Use Permit would be contrary to pending
proposals for the E1 Camino Real Plan, and would not be consistent
with the Downtown Plan;
5. that granting of the Use Permit would be contrary to precedent in
furtherance of policy heretofore established to prohibit the sale or
use of alcoholic beverages in an zone in the vicinity of Sequoia High
Sch oo 1.
Reg.
