Item No. 1. (continued)
Motion carried by the following roll call vote:
Ayes: Councilmen Chandler, Claire, Mosher and Rhodes
Noes: Councilmen Bury, Stangel and Mayor Britschgi
MINUTE ORDER NO. 85 -45
(Council recessed from 8:45 to 8:55 p.m.)
---------------------------------------------------------------------------- - - - - --
ORAL COMMUNICATIONS
1. Jack Denton, 330 Turks Head, requested help of Council with respect to an
addition on property at 416 Lanyard which he believes to be without a permit
to do so, and also believes is intended for some kind of business use; that
the property is in the R -1 Zoning District. He was concerned regarding the
affect on the immediate neighborhood; asked if zoning for the area had been
changed, and whether a permit had been issued; and requested assistance
with respect to steps to be taken to preserve the integrity of the area. He
indicated there was concern that the intention is to use the addition for
some type of residential care home for the elderly.
In response to question by Council, Mr. Denton acknowledged that their
suspicions as to the proposed purpose is conjecture on their part.
2. Mel H. Rich, 420 Lanyard Drive, stated that he lives next door to 416
Lanyard, and was also concerned regarding the construction, which appears to
be a 4- bedroom addition. He was dissatisfied with what he described as an
inadequate foundation, and indicated that there seems to be no on -site
inspection nor building permit.
Discussion followed regarding whether residential care homes were permitted
in R -1 Zoning Districts, and Planning Director Schroeter advised that the
City's right to regulate residential care homes for the elderly has been
preempted by the State.
Mayor Britschgi asked that staff investigate and report back to Council.
MEMO 4/19/85
---------------------------------------------------------------------------- - - - - --
REPORTS OF BOARDS, COMMISSIONS AND COMMITTEES
2.
