Item No. 4 (continued)
Dr. Rocky Tarantello, Economist, 3901 MacArthur Blvd., Newport Beach,
referred to an overhead projection of a list of 18 Bay Area mobilehome parks
and space rents charged in each. He stated he was asked to review the
proposed lease and found it to be a straightforward document; reviewed the
sources of information gathered for his analysis and the rationale for
standards established for rental fees.
The members of the Committee commented in turn, as follows; Councilman Bury
and Rhodes, Caroline Duarte, 262 E. Edith, Los Altos, Jack Greenalch, 870
Seminole Way, George Davenport, 215 Upland Road, and Roland Jedlick, 2053 E.
Bayshore.
Mayor Britschgi commended the Committee for its report and for its
conscientious and diligent efforts to try to resolve the matter.
Mobilehome owners invited to speak were as follows: Susan Morrison, Walter
Hogue, 1933 E. Bayshore, Carol Banger, 3015 E. Bayshore, and Inga Swaggart,
Belmont, who expressed a number of concerns, among them, a lack of a "cap' on
the space rent increases; and indication that they did not believe they had
adequate representation on the Committee; that although they are homeowners,
they are treated like second -class citizens; that some of the undesirable
provisions in the lease had to do with pass - throughs to the mobilehome owners
of various costs, and that under sublease, up to a 15% increase is allowed.
Mobilehome park owners invited to speak were as follows: Al Engel, 2533
Round Hill Drive, Alamo, one of the owners of Harbor Village; Terry R.
Dowdall, 203 N. Golden Circle, Santa Ana, attorney representing the park
owners; Pamela Middlebrook, 1121 "L" Street, Sacramento, Western Mobilehome
Association; Al Russell, realtor, 238 Santiago, Redwood City; and Bill
Kitchens, 792 Meridian, San Jose, with Tri- County Apartment Association, who
commented on the process of developing a short and simple lease agreement,
the procedure manual which creates a mediation committee within the parks;
the consumer price index should be considered a reliable basis for rent
increases, and that a cap was not recommended because the park owners were
well behind the market; that they considered the composition of the committee
as well - balanced, affording ample opportunity for participation by the
opposing interests, that the lease protects the interest of the mobilehome
owners as no rent control ordinance would; that the compromises address the
issue of predicability of what can be expected for the mobilehome owner,
while at the same time addresses the issue of a fair amount of return to the
park owner; and that the compromise meets the needs of both parties and
provides for individual negotiation without government regulations.
Mayor Britschgi read from the text in the proposed resolution, and stated
that it is not intended that Council become involved with the lease or other
matters that are rightly private matters.
Title read.
