Public Hearing - Appeal of approval by the Zoning
Adminstrator of an Architectural Permit for property at
416 Lanyard - Jack V. Denton, appellant (203 -10)
Report of City Manager and Chief Building Official 4/19/85
Chief Building Official Malkemus provided a background relating to
application for the various permits to build a 4- bedroom addition to an
existing home, to provide a residential care facility at 416 Lanyard; reviews
and approvals by Building, Planning, Public Works and Fire Departments; that
the required Building Permits have been issued, and normal processing such as —
plan checking, has been completed. He commented on events following filing
of the appeal; meetings held with the appellants and reviews made of the
plans; the contention of the appellants that the proposed lot coverage might
exceed the 40% lot coverage permitted; the fact that the engineering design
criteria for foundations for this type structure were met; that on -site
inspection was made, and other efforts made to satisfy the complaints of the
appellants; that initially, work had begun on the foundation without
permits, and a stop order issued by the City, and that since an appeal has
been filed, work has ceased. He added that in reviewing the plans, and from
his inspection, he has found nothing to prohibit continuance of construction.
Mayor Britschgi declared the public hearing open at 7:50 p.m.
Jack Denton, 330 Turks Head, described the concerns he and other neighbors
had regarding compliance with construction and zoning requirements with
respect to the addition to the home, and replied to questions by Council
regarding their estimate of the square footage of the additions, of lot
coverage, that their concerns go beyond the construction aspect and that
they are pursuing ways in which the CC &Rs can be enforced.
Melvin Rich, 420 Lanyard, supported Mr. Denton's remarks, and stated that his
house was the exact reverse plan of the house at 416 Lanyard.
John Cooper, 609 Lancaster Way, spoke in favor of residential care homes for
the elderly. --
Reg.
