Item No. 2 (continued) <br />ORDINANCE ADDING SECTION 60.20.12, TO ORDINANCE 1130, THE REDWOOD CITY ZONING <br />ORDINANCE, REGARDING PROPERTY LOCATED GENERALLY EASTERLY OF STATE HIGHWAY 101 <br />BOUNDED IN PART BY MARINE WORLD PARKWAY EAST AND BELMONT SLOUGH, IN THE CITY <br />OF REDWOOD CITY, AND MAKING CERTAIN FINDINGS WITH RESPECT THERETO ( "MARINE <br />WORLD EXECUTIVE PARK") <br />approved for first reading unanimously by roll call vote. <br />---------------------------------------------------------------------------- - - - - -- <br />3. Public Hearing -- Resolution of Intention of the <br />Planning Commission to amend Ordinance No. 1130 with <br />respect to requiring Use Permits for the outdoor sales <br />of merchandise (203 -02) <br />Planning Commission record transmitted 4/18/85. <br />Planning Director Schroeter commented and replied to questions by Council <br />regarding the fact that the proposed ordinance was initiated when the outdoor <br />sales noticeably increased at the time of the Super Bowl game at Stanford; <br />that the intention was not to prohibit sales, but to require a Use Permit to <br />which conditions could be attached; that with regard to outdoor sales, he <br />could see three interpretations: that the City can take the position that <br />they are to be considered legal; or illegal; or legal but non - conforming, <br />which would be limited to three years. City Attorney Schricker suggested <br />that the Zoning Administrator should have some guidance from Council because <br />the ordinance will require some administrative interpretation; that there <br />might be exceptions, such as Christmas tree lot sales and fireworks sales, <br />the latter being regulated under another ordinance, and standards needed to <br />be established. Mr. Schroeter noted that it is conceivable that certain <br />types of outdoor sales can be attractive; that in the event an application is <br />denied, that action can always be appealed to the Council, and that the - <br />disposition of the appeal would be helpful in guiding future administration <br />of the ordinance. <br />Mayor Britschgi declared the public hearing open at 8:10 p.m. <br />Mayor Britschgi invited anyone else present who wished to speak to do so.
