Item No. 2 (continued) <br />M /S: Chandler /Mosher that the Council respectfully reject the offer of the <br />Housing and Human Concerns Committee to review the Fair Rent Compromise Lease <br />approved by the City Council on April 22, 1985. (Second to the motion was <br />made based on the statement that the maker would cite his reasons during <br />discussion.) <br />City Attorney Schricker commented and replied to questions by Council <br />suggesting that if Council were to order reconsideration of the issues, it <br />would be favoring one side; that ordinarily, once legislative action is <br />taken, it remains in effect as a statement of the legislative policy of the <br />Council; that justification for reopening an issue in exceptional <br />circumstances might be if new facts were presented for consideration, which <br />in this situation does not appear to be the case; that Council had set up an <br />ad hoc committee with the intent of helping the situation, and is trying to <br />mediate what is really a private dispute. <br />Councilman Chandler stated that his motion was made for the reasons that no <br />new information has been presented to Council since the action taken on April <br />22, 1985; the lease is totally voluntary to the mobilehome owners and park <br />owners; and the City Council has not in the 31 years that he is familiar <br />with, had an oversight committee that went back and reviewed Council's final <br />decision; that when Council makes a decision, that decision has always stood, <br />and to do otherwise could lead to charges of bad faith bargaining and <br />exposure to potential litigation. <br />Motion carried by the following roll call vote: <br />Ayes: <br />Noes: <br />Chandler, Rhodes, Stangel and Mayor Britschgi <br />Bury, Claire and Mosher <br />MINUTE ORDER N0. 85 -83 -1 <br />ORAL COMMUNICATIONS <br />.1 E.R.
