Item No. 3 (continued) <br />3. That the two oak trees shown in the right -of -way for Horgan <br />Avenue, be inspected by a professional tree surgeon to <br />determine their condition and whether they should be retained; <br />the findings shall be reviewed and confirmed by the Park and <br />Recreation Department prior to issuance of any construction <br />permit. <br />4. That a plan for all trees within or adjacent to paved surfaces <br />be prepared by the applicant which shows how the roadways are <br />to be constructed in order to preserve the trees; this plan <br />shall be approved by the Park and Recreation Department prior <br />to any excavating or paving work. <br />5. That the developer pay $2,240 to the City as their share of the <br />cost for the prior preparation of the Horgan Ranch Specific <br />Plan and EIR. <br />6. That the Planned Development Permit be recorded prior to the <br />commencement of construction. <br />7. That all recommendations of the Department of Public Works <br />contained in the attached communication from the Director of <br />Public Works to the Planning Director, dated December 27, 1983, <br />be made conditions of approval (see below -- one change to be <br />made). <br />8. That the terms and conditions of the subject permit inure to <br />the benefit of, and be binding upon, the permittee or his <br />successors, heirs, grantees, assigns, and transferees, and <br />apply to the entire Planned Development area or any portion <br />thereof. <br />Public Works Director <br />Change wording of section of Report of December 27, 1983 as follows: <br />I. Public Streets <br />1. b. Horgan Avenue shall have an ultimate right of way width <br />of 60'. The roadway width, measured from face of curb <br />to face of curb, shall be 40' wide with 10' wide parkway <br />on each side. On each side of the roadway, within the <br />parkway, a 5' wide sidewalk, 5.50' including the top of <br />curb width, shall be built monolithic with the curb. <br />The full right of way width, 60' wide, shall be dedicated <br />for street purposes within the subdivision for Horgan Avenue. <br />Reg.Mtg. <br />1/9/84 <br />Page 3 <br />MINUTE BOOK NO. 44 <br />Page No. 316 <br />
