Public Hearing - Abatement of Public Nuisance - <br />Building at 851 Brewster Avenue, Alisal Land Co., Menlo <br />Park (Continued 30 days from 3/26/84) (702 -11) <br />Mayor Britschgi noted that the subject public hearing was continued from <br />March 26, 1984 and declared it reopened at 7:45 p.m. <br />Building Official Malkemus reported that the owner of the subject property <br />has taken action to remove the potential hazards presented by the building by <br />eliminating the opportunity for unauthorized entry, stating that his <br />department and the Police Department will monitor it continuously. <br />William Conklin, 275 Ridgeway Road, Woodside, President, Alisal Land Co., <br />owners of the property, reported that he will continue to make a daily tour <br />of the property to insure it remains secure, noting that plans for the <br />development of the property involve removing the building. Mr. Conklin <br />stated that application has been made and preparation of an environmental <br />impact report is pending. In response to question, Mr. Conklin acknowledged <br />that he does not yet have financing for the proposed development, but said he <br />will have to have an approved development before he is able to obtain <br />funding. <br />In response to question, City Attorney Schricker said that adoption of the <br />proposed resolution is not recommended. Mr. Schricker suggested that Council <br />can, as a matter of policy, find that the building is a continuing nuisance <br />or a nuisance likely to recur and could proceed to abate the structure, with <br />recovery later by advance agreement with the owner, as an assessment against <br />the property. Mr. Conklin stated that such an agreement would be <br />satisfactory to his company. <br />Mayor Britschgi invited anyone else present who wished to speak to do so. <br />No one wished to speak. <br />M /S: Stangel /Chandler to close the public hearing. <br />Carried unanimously by voice vote and public hearing closed at 8:05 p.m. <br />M /S: Claire /Chandler to continue the subject matter until June 11, 1984 and <br />direct staff to explore with the property owner the possibility of abating <br />the nuisance using City funds to be repaid as soon as the developer receives <br />financing for his development. <br />The motion carried on the following roll call vote: <br />Reg.
