Item No. 4 (continued)
Maureen Gallaqher - Stoney and Jim Stoney, 968 Pleasant Hill Road, the
- .
applicants, indicated they have a letter from the neighbor whose trees would
be trimmed stating there is no objection and that the trees which will be
removed will be replaced by larger ones. They said the PG &E representative
had explained the procedure for moving and replacing the utility pole to Mr.
Allen and noted that the Director of Public Works agrees there will be no
drainage problems, if they proceed with construction planned. They also said
they plan heavy landscaping in order to assure their own privacy and that of
Mr. Allen which will be improved.
Discussion continued and it was pointed out that the utility easement is for
overhead wires only and extends some 24 -feet into the Stoney property while
also serving the similar -size Allen property which has no such easement, and
that the line was installed for the convenience of the utility company rather
than shared equally by adjacent property owners.
Janet Hay, PG &E Company representative, reported that it is proposed to
construct the pole line off to one side where it will be less visible than at
present, and where the required 6 -foot clearance can be maintained.
Mayor Britschgi invited anyone else present who wished to speak to do so. No
one wished to speak.
M /S: Stangel /Bury to close the public hearing.
Carried unanimously by voice vote public hearing closed at 8:40 p.m.
Title read. Councilman Claire continued that he
favors the proposed vacation of easement because a professional engineer
believes that no drainage problem will occur and drainage may be improved and
because of his visit to the site he knows that Mr. Allen's backyard has no
privacy now, so it will not be changed for the worse.
The resolution was adopted on the following roll call vote:
Ayes: Councilmen Bury, Chandler, Claire, Stangel and Vice Mayor
MoZ"',er
Noes: Councilman Rhodes and Mayor Britschgi
(City Council recessed from 8:47 to 8:55 p.m.)
---------------------------------------------------------------------------- - - - - --
Reg.Minutes
9/17/84
Page 4
MINUTE BOOK NO. 45
Page No. 135
