Public Hearing - Proposed' abatement of Public Nuisance,
67 Charter Street ( 702 -11)
Report of City Manager and Chief Building Official 8/24/84
Mayor Britschgi declared the public hearing open at 7:52 p.m.
Chief Building Official Malkemus referred to the subject report describing
the conditions which prompted the proposed public nuisance abatement. Mr.
Malkemus reported that the tenants have been removed and gas and electric
power have been disconnected, stating that the owners have taken out a
demolition permit which runs for 180 days. He suggested that Council might
wish to continue the public hearing for three weeks pending investigation as
to the status of the demolition efforts.
In response to questions, Mr. Malkemus acknowledged that demolition efforts
have been slow and that if the proposed resolution were adopted this evening
that the property owner would have 30 days in which to comply. He noted that
the owner may believe that by taking out the permit, the abatement
proceedings would be halted for the 180 -day duration of the permit, although
the owner was not so advised.
In response to question, City Attorney Schricker said the owner has no legal
obligation to use the demolition permit, but that if the proposed resolution
is adopted, the owner will have 30 days in which to do so, or the City may do
so at the owner's expense.
Mr. Malkemus reported that the property owner has had notice of the abatement
proceedings, and the property was posted with the appropriate notice.
Reg.Mtg.
10/1/84
Page 3
MINUTE BOOK NO. 45
Page No. 146
