Item No. 1 (continued) <br />Affidavit of Publication of Notice of Hearing is on file. <br />Mayor Br itschg i declared the public hearing open at 7:42 p.m. <br />Craiq Nikitas, author of the appeal letter and representative of the <br />appellant, introduced Mr. Arakelian. Mr. Nikitas referred to the appeal <br />letter and to slides depicting other automobile oriented businesses near the <br />subject site; views of the site plan and of the proposed building and <br />landscaping. Mr. Nikitas suggested the building could be used at some later <br />date for offices and filed copies of reductions of the revised plan prepared <br />for the proposed automobile repair use. <br />Planning Director Schroeter presented the subject report and noted that in <br />addition to the Use Permit and Variance which were denied another Variance <br />would be necessary for which application has not been made, stating that only <br />20'9" has been allowed for backout space where 25' is required. Mr. <br />Schroeter said that he denied the applications based on Council policy <br />direction contained in the Zoning Ordinance. He presented a slide of the <br />entire corner site, noting that the three separately owned parcels might be <br />combined in the future for good development of a type desired by the City and <br />that the appellants property is a small strip bounded by the other two. <br />Discussion followed and Mr. Schroeter replied to questions and commented <br />concerning Council policy; the requirements of zoning in the area; the desire <br />to upgrade El Camino Real; and development taking place nearby where parcels <br />have been combined. <br />Mayor Britschgi invited anyone else present who wished to speak to do so. No <br />one wished to speak. <br />M /S: Stangel /Rhodes to close the public hearing <br />Carried unanimously by voice vote and public hearing closed at 8:16 p.m. <br />Claire /Mosher to uphold the denial by the Zoning Administrator of the Use <br />Permit and Variance for property located at 2306 E1 Camino Real and 21 Hazel <br />Street owned by Vartkes Arakelian; that the appeal is denied on the basis of <br />policy direction given to the Zoning Administrator; and to incorporate the <br />following findings of the Zoning Administrator: <br />1. Auto repair garages are not a permitted or conditionally permitted use in <br />the "CP" (Commercial Park) District <br />2. The facility, as proposed, does not compare with other permitted or <br />conditionally permitted uses in the "CP" District, which District is <br />intended to represent "front door" areas of the City. <br />3. The narrow lot, with a narrow building with multiple garage doors opening <br />onto a long asphalt driveway, facing the E1 Camino Real /Woodside Road <br />interchange, and used as an auto repair garage, defeats the purpose and <br />intent of the Zoning Ordinance for "CP" Districts. <br />Reg.Mtg. <br />12/3/84 <br />Page 2 <br />MINUTE BOOK NO. 45 <br />Page No. 198 <br />
