Item No. 1 (continued)
4. For a use such as this to be compatible with the purpose of the "CP"
District, it would have to be redesigned to appear and function as a
permitted use, e.g., a research facility, office, laboratory, or ( indoor)
distribution center, with more than the normal amount of landscaping to
screen the "auto repair garage" nature of the use.
5. In contradiction to the above, a variance is also being sought by the
same applicant to reduce the width of landscaping along Hazel Avenue to
less than that which is required for permitted uses in the "CP"
District.
6. There are no unusual circumstances pertaining to the property that would
require a Variance for reasonable economic return.
7. The proposed use is unusual for such a location and such size of
property, but that is not a valid basis for granting a Variance.
8. Such a Variance would be a grant of special privilege and contrary to the
intent of the Zoning Ordinance.
9. This lot for the proposed "auto repair garage" is one of two adjoining
properties that have very recently been cleared of dilapidated buildings
and that are advantageously situated, in a commanding location, to take
advantage of the kinds of development anticipated and planned for the
"CP" (Commercial Park) District; it would be premature to abandon the
Zoning Ordinance objectives for this prime location at this time.
The motion carried on the following roll call vote:
Ayes: Councilmen Chandler, Claire, Mosher, Stangel and Mayor Britschgi
Noes: Councilmen Bury and Rhodes
MINUTE ORDER NO. 84 -190
M /S: Bury /Claire to ask the Planning Commission to examine and upgrade the
existing plan for E1 Camino Real so that it can be brought back to Council
soon.
CLARIFICATION: Following discussion, it was determined by Mayor Britschgi
that Council would like to have a joint meeting with the Planning Commission
shortly after the first of 1985 for the purpose of considering the E1 Camino
Real Plan.
Carried by majority voice vote which Mayor Britschgi determined to be 6 to 1.
MINUTE ORDER NO. 84 -193
---------------------------------------------------------------------------- - - - - --
ORAL COMMUNICATIONS - NONE
----------------------------------------------------------------------------------
(Council recessed from 8:25 to 8:30 p.m.)
REPORTS OF BOARDS AND COMMISSIONS
Reg.Mtg.
12/3/84
Page 3
MINUTE BOOK NO. 45
Page No. 199
