<br />At the request of City Attorney Schricker, all of the subject applicants <br />and representatives of the appraisal company were sworn by City Clerk <br />Hildebrand. <br /> <br />1. <br /> <br />William Henry Twohy, 551 Skiff Circle, stated that the assessed value <br />of his property is greater than for a similar house across the street, <br />that the assessor did not look at his property and that it could not <br />be sold for the amount assessed of $167,900 as market value. Mr. <br />Twohy requested the assessed value of his property be reduced. <br /> <br />Roger Torkelson, 1 Ashbury Terrace, San Francisco, representing <br />American Appraisal Company, referred to the information sheet provided <br />for Mr. Twohyls property noting he had used the median price of some <br />seven sales of the identical plan by the same builder and described <br />his appraisal process. <br /> <br />It was pointed out that property value is considered as of March 1, <br />1982. <br /> <br />Discussion followed concerning details of the appraisal procedure with <br />specific reference to Mr. Twohyls property and similar properties. <br /> <br />In response to questions from Mr. Schricker, Mr. Torkelson said he has <br />used a market data appraisal approach, that there were no sales of <br />identical property since September 1981 and that all identical models <br />were assessed in the same manner. <br /> <br />Bruce Albin, 569 Compass Drive, suggested that since many of the homes <br />on Skiff Circle are not well maintained in accordance with require- <br />ments of the CC&Rs (conditions, covenants and restrictions) that they <br />are worth less than the identical homes in other better maintained <br />locations. It was pointed out that reductions in assessment are not <br />intended to be granted to reward those who violate CC&R requirements. <br /> <br />Discussion continued concerning the responsibilities of the Board of <br />Equalization in evaluating applications and what may be relevant to <br />reduction. <br /> <br />M/S: Biagi/Britschgi to deny the application of William Henry Twohy, <br />Parcel No. 095-063-070, 551 Skiff Circle for assessment adjustment and <br />that like properties are to be treated similarly as to use of a median <br />assessment figure. <br /> <br />In response to question, Mr. Schricker stated that there is no <br />expectation that members of the Board of Equalization would make a <br />field survey of the subject properties, professional appraisers having <br />been employed to do so who may be questioned to the satisfaction of <br />Board members. <br /> <br />The motion carried by majority voice vote which Mayor Stangel <br />determined to be 5-1. MINUTE ORDER NO. 83-6 <br /> <br />2. <br /> <br />H. C. Clough, 30 Deodora Drive, Atherton, owner of 23 Admiralty Place, <br />stated there have been no recent sales of comparable properties and <br />that he believes the value of his property has declined. Mr. Clough <br />said that his assessment has increased 16% and requested that the <br />amount be reduced to 8%. <br /> <br />Mr. Torkelson noted two sales on the same street of the same models in <br />September 1981 and also sales of two smaller models, one of which <br />occurred as of the assessment date, both of the smaller models selling <br />for more per square foot than for Mr. Clough1s property. He replied <br />to questions relating to the occasional need to IIcatch Upll and noted <br />that even if there is an adjustment downward as of 3/1/83 to reflect <br /> <br />Bd.
