Presentation of Resolution of Retirement to Joe V. <br />Collier, Department of Public Works - Engineering, after <br />14 years (301 -11) <br />RESOLUTION NO. 9303 COMMENDING AND CONGRATULATING JOE V. COLLIER ON THE <br />OCCASION OF HIS RETIREMENT <br />Mayor Stangel presented a framed parchment copy of RESOLUTION NO. 9303, <br />adopted unanimously by consensus of Council, to Joe Collier and thanked <br />him for his years of service to the City. <br />Director of Public Works Addiego reported that February 28 is Mr. <br />Collier's birthday and presented a special birthday greeting prepared and <br />signed by employees in the department to him. <br />---------------------------------------------------------------------------- - - - - -- <br />4. Public Hearing - Proposal to reduce or eliminate Bond <br />Authorization - General Improvement District No. 1 -64 <br />(901 -13) (continued closed from 1/24/83) <br />Report of City Manager and Director of Public Works 2/24/83 <br />(See also Minutes of Public Hearing 1/24/83) <br />Mayor Stangel noted that the subject public hearing was continued closed <br />following testimony given on January 24 and stated that the subject is now <br />before Council for consideration. <br />City Attorney Schricker replied to questions relating to the legal <br />position of a future owner in the South Shores area with regard to <br />attacking cancellation of authorized bonds; whether the $30 million <br />recommended by the Advisory Committee to be retained for South Shores can <br />be retained without impact on the owners of Redwood Shores property; <br />whether legal documents can be constructed which would provide for <br />alternate security; the difficulties inherent in making any "guarantee "; <br />the responsibility for costs of levee repair in the event of deauthori- <br />zation of the bonds; whether Council would have to take emergency action <br />using City general funds in the event of levee breaks or other damage; <br />whether it is practical to expect that the City would be able to recover <br />costs from the District after the fact, if general funds were expended in <br />an emergency situation; and that funds might be immediately available if <br />the bonds could be issued. <br />In response to question, Director of Public Works Addiego said that if <br />levees remain short of Army Corps of Engineers standards, that flooding <br />could reach five feet under certain heavy storm situations. <br />Discussion continued and City Manager Smith, Mr. Addiego and Mr. <br />Schricker replied to questions regarding conditions of the levees today; <br />the cost to bring the levees up to Corps of Engineer standards; the <br />probable cost of maintenance; the fact that use of general obligation <br />bonds is no longer available; the percentage of Council vote required to <br />deauthorize the bonds; the expectation that state and federal aid would <br />not be available in sufficient amounts to cover all damage caused by <br />Reg.Mtg. <br />2/28/83 <br />Page 2 <br />MINUTE BOOK NO. 44 <br />Page No. 64 <br />
