Item No. 3 (continued) <br />concerning examples of hazardous traffic maneuvers which might occur. <br />Mayor Stangel invited anyone else present who wished to speak to do so. <br />No one wished to speak. <br />M /S: Mosher /Biagi to close the public hearing. <br />Carried unanimously by voice vote and public hearing closed at 9:45 p.m. <br />M /S: Mosher /Britschgi to uphold the decision of the Zoning Adminis- <br />trator and deny the appeal of Mc Donald's Corporation of Conditions of <br />Approval for development of a Mc Donald's Restaurant, 536 Whipple Avenue, <br />based on the following findings: <br />1. that the Zoning Administrator has interpreted Sec. 16(K) of the <br />Zoning Ordinance consistently to preclude drive -in food establish- <br />ments in CP (Commercial Park) Districts; <br />2. that said interpretation is consistent with the purposes of the <br />Zoning District regulations; <br />3. that the proposed use, including the drive - through design feature, <br />would create traffic congestion at that portion of Whipple where the <br />property is located which is subject to heavy traffic at the same <br />time as a high demand for the usage of the applicant's company would <br />occur; further, that said congestion would be exacerbated by Circle <br />Star Theatre patronage in that traffic stopped at traffic signals <br />backs up in the vicinity of the property; and further that it would <br />be inconsistent with and exacerbated by the proposed freeway <br />interchange project; and <br />4. that the proposed use, including the drive - through design feature, <br />would create traffic hazards in that left turn cross traffic would be <br />attracted to the site causing hazardous vehicular turning patterns in <br />congested traffic areas; and further, the proposal would create <br />traffic stacking inconsistent with the traffic flow patterns on that <br />portion of Whipple Avenue. <br />Carried by majority voice vote which Mayor Stangel determined to be 6 -1. <br />MINUTE ORDER NO. 83 -34 <br />REPORTS OF BOARDS AND COMMISSIONS <br />4. Planning Commission recommendation of approval of PCA <br />(Peninsula Celebration Association) proposal to prepare <br />site south of Peninsula Boardwalk Shopping Center for <br />relocation of an historic building; and recommendation <br />that Permit PRC 5466.9 of the State Lands Commission be <br />amended to allow the proposal <br />Report of City Manager 3/2/83 <br />Planning Commission record transmitted 2/14/83 <br />Pete Hughes, Peninsula Celebration Association, said that although the PCA <br />has no specific historic building in mind, they would like to have the <br />site ready in order that it would be available when they are able to move <br />such a building there to be refurbished and used for the PCA office. <br />Discussion followed and Planning Director Schroeter and City Attorney <br />Schricker, City Manager Smith and Director of Public Works Addiego replied <br />to questions and commented concerning the appropriateness of the site for <br />location of an historic building; the lack of vehicular access to the <br />site; the possible public use of the area or building; the previous plan <br />Reg.Mtg. <br />3/7/83 <br />Page 5 MINUTE BOOK NO. 44 <br />Page No. 75 <br />
