Item No. 3 (continued) <br />Report of City Manager and Building Official transmitting reports of <br />Building Department, Fire Department and San Mateo County Health <br />Department transmitted 6/9/83 <br />At the request of City Attorney Schricker, all prospective witnesses stood <br />and were sworn by City Clerk Hildebrand. <br />Building Official Malkemus reported that the subject building is posted <br />with Notice to Abate Nuisance signs and that Letter Notice was hand de- <br />livered to the property owner by a Police Officer at 12:57 p.m., June 15, <br />1983. Mr. Malkemus described conditions prompting abatement proceedings. <br />Fire Prevention Officer Ornelas described the circumstances he observed <br />on the second floor living units stating that they present immediate <br />potential for danger and loss of life. Mr. Ornelas described the inten- <br />tionally set fire he observed and the present condition of the building <br />involving structure and electrical system. Mr. Ornelas also replied to <br />questions from City Attorney Schricker concerning details of his inspec- <br />tion of the building. <br />In response to question, Mr. Schricker stated that conditions in the <br />building were considered to be so bad and the need to vacate the building <br />so urgent, that the present proceedings were undertaken rather than <br />waiting to obtain a court order. <br />Police Capt. Hamilton described the investigation of the subject premises <br />at the time of his investigation of a homicide there on December 3, 1982. <br />Capt. Hamilton provided photographs of the building conditions which he <br />described. <br />Patrick Ryan, owner of the subject property, stated he had purchased it <br />about a year ago and leased it. Mr. Ryan suggested it is an old but sound <br />building with conditions which need improvement, suggesting it provides <br />some needed housing and stating that he needs the retirement income. <br />Mr. Ryan replied to questions of Council, Mr. Schricker and City Manager <br />Smith concerning the condition of the building; the recent fires there; <br />the police problems; whether any reconstruction is possible; present Code <br />requirements; his general knowledge of the building and the uses which <br />have been made of it; and the requirement that the nuisance of the build- <br />ing be abated by reconstructing or properly repairing or razing it within <br />30 days. <br />Mr. Ornelas reported further that he had talked with the representative of <br />the owner's fire insurance firm and stated that the previous owners stated <br />that no one formerly lived on the second floor. <br />Title read.
