Item No. 1 (continued) <br />Bruce Albin, 569 Compass, reported that the Redwood Shores Homeowners <br />Association has conducted a public opinion poll of Redwood Shores <br />residents through the use of "The Pilot" publication. Mr. Albin reported <br />results regarding ranking of their concerns and stated results will be <br />published in the July issue. <br />Martin Simonetti, 27 Cove Lane, owner of a two - bedroom unit, prefers the <br />development of Phase II as proposed by Podell and would like to have it <br />undertaken as soon as possible. Mr. Simonetti suggested all owners will <br />be better protected with regard to property values, when the entire <br />development is completed. <br />John Hanna 525 University Avenue, Palo Alto, attorney for M. H. Podell <br />Company, representing Pelican Cove Development, read the declaration of <br />the Final Public Report containing recorded CC &Rs which must be furnished <br />to each buyer to be read and a receipt signed before the sale is <br />completed. He also read the note contained therein relating to the <br />intention of the developer and his rights to make changes. Mr. Hanna <br />reported the receipts of buyers of Pelican Cove units are maintained on <br />file. He said that one condition of the Tentative Map required that CC &Rs <br />be revised, if necessary, to reflect changed conditions, stating amendment <br />is not needed and that the standard declaration of annexation will be <br />filed for Parcel B. <br />Discussion continued and Mr. Hanna, Mr. Schroeter and Mr. Schricker <br />replied to questions concerning details of requirements of the developer. <br />Michael Galligan (see above) stated his understanding that while there was <br />no assurance the development would be built as described that if it were <br />built, it could be only as originally described. <br />Mr. Schroeter replied to questions from Mr. Schricker regarding lack of <br />existence of a specific plan for the area; the fact that the R -3 zoning <br />and the density of the development are consistent with the General Plan, <br />as are other features; that no public health problems are presented; that <br />there is no conflict with public easements; and that it is consistent with <br />sewerage treatment requirements. <br />Mayor Stangel invited anyone else present who wished to speak to do so. <br />No one wished to speak. <br />M /S: Biagi /Mosher to close the public hearing. <br />Carried unanimously by voice vote and public hearing closed at 9:43 p.m. <br />M /S: Biagi /Mosher to deny the appeal from the decision of the Planning <br />Commission to approve the application of M. H. Podell Company to amend a <br />previously approved Tentative Map to increase the number of units in Phase <br />II, Pelican Cove Condominiums from 76 to 94, 400 Marine World Parkway, <br />Michael F.
