ORAL COMMUNICATIONS <br />There being no objection, Mayor Stangel ordered that Oral Communications be <br />considered out of order at this time. <br />Dermod Houweling, 1039 Silver Hill Road, stated that he was a witness to <br />the fatal automobile accident involving a police vehicle on Saturday, <br />July 30 at Broadway and Jefferson. Mr. Houweling commented unfavorably <br />concerning press statements and the lack of statements by Council members <br />and objected to the consideration of the matter in executive session. He <br />questioned the conduct of the investigation of the accident by the <br />California Highway Patrol. <br />City Attorney Schricker stated that the executive session scheduled for <br />this evening involves workers' compensation, but that the Council may also <br />discuss the City's position with regard to the accident in such a session, <br />since it involves both personnel and possible litigation. Mr. Schricker <br />also advised that in order to insure objective investigation by a com- <br />petent outside agency, it is the policy of the present administration to <br />turn over matters involving police accidents to the California Highway <br />Patrol. <br />In response to questions, Mr. Schricker and City Manager Smith stated that <br />regulations and policy are matters of public record, but certain aspects <br />of an accident case are confidential in order to protect the rights of all <br />involved and that statements volunteered in anticipation of possible <br />allegations may lead to infringement of rights. <br />Discussion followed and Council members expressed their regrets about all <br />aspects of the tragic accident. <br />WRITTEN COMMUNICATIONS <br />17. Letter from Stuart Auchincloss on behalf of Peninsula <br />Christian Center requesting City Council to consider <br />the denial of their appeal for late filing (203 -10) <br />Stuart Auchincloss, lawyer, 525 Middlefield Road, inquired about the <br />handling of his subject request. City Attorney Schricker stated that the <br />letter is before Council for their decision as to whether or not to set a <br />public hearing on the request to consider the denial of the appeal for <br />late filing. <br />Mr. Auchincloss reviewed his letter and commented concerning the <br />contents. <br />Mr. Schricker advised that the City has the duty to notify applicants of <br />Planning decisions, but the applicants have the responsibility of <br />determining their appellant rights, although the Planning Director may <br />volunteer that information as a convenience to the applicant.
