WRITTEN COMMUNICATIONS (continued) <br />Schricker stated that the Minutes of the Planning Commission meeting of <br />May 3, 1983 reflect the announcement of the appeal procedure and deadline, <br />and the tape recorder recorded the announcement. <br />In response to question, Planning Director Schroeter reported that it is <br />routine practice at the close of any item where the decision might have <br />been adverse to the applicant to announce the appeal procedure and <br />deadline for filing. Mr. Schroeter stated that he made the announcement, <br />and, at the request of Chairman Castle, repeated it, and it was picked up <br />on the tape both times. <br />Mr. Auchincloss acknowledged that he had not listened to the tape but had <br />relied on a report to him that the announcement was not on the tape. <br />Chairman Castle confirmed that at the conclusion of the public hearing, <br />Mr. Schroeter had made the announcement and that he had asked him to <br />repeat it, because of the commotion in the room. <br />Discussion followed and Mr. Auchincloss, Mr. Schroeter and Mr. Schricker <br />replied to questions and commented concerning the background and present <br />status of the Planned Development Permit (PDP 83 -03). <br />Lyle Hughes, 1518 Arguello Street, member of the Peninsula Christian <br />Center, reported he was present at the Planning Commission meeting and did <br />not hear Mr. Schroeter's announcements. Mr. Hughes recalled hearing only <br />a call for recess. <br />In response to question, Mr. Schroeter stated there was commotion in the <br />audience following the Planning Commission decision which was the reason <br />for making the announcement twice. He noted that he made the same <br />announcement following the preceding item, so the procedure itself could <br />have been observed. <br />In response to question, Mr. Schricker advised that although the Planning <br />Commission has denied the application of Peninsula Christian Center for a <br />Planned Development Permit (POP), there is no restriction against the <br />Center from immediately making application again upon payment of the <br />appropriate fees. <br />M /S: Biagi /Bury to deny the request of Peninsula Christian Center for <br />public hearing on the question of jurisdiction relating to denial for late <br />filing of their appeal of the Planning Commission denial of Planned <br />Development Permit of May 3, 1983. <br />The motion failed on the following tie roll call vote: <br />Ayes: Councilmen Biagi, Bury, Mosher <br />Noes: Councilmen Claire, Rhodes and Mayor Stangel <br />Reg.Mtg. <br />8/8/83 <br />Page 7 <br />MINUTE BOOK NO. 44 <br />Page No. 204 <br />
