REPORTS OF CITY MANAGER (continued) <br />10. Award of contract - Seaport Boulevard Reconstruction, <br />Phase I (702 -02) <br />Report of City Manager and Director of Public Works 8/17/83 <br />Director of Public Works Addiego reported that Lincoln Property Company <br />has assured him that funds will be on deposit for the project today and <br />that a copy of the plans and specifications for the project has been <br />submitted to George Huxhold of Pacific Gas & Electric Co. (PG &E) who has <br />been advised the City plans to proceed with the project. <br />City Attorney Schricker reported that he has received a copy of the letter <br />from Mr. Huxhold of PG &E asserting certain prior rights to the subject <br />property, but that the City is not in agreement with that assertion. <br />Jan Hay, 2417 Broadway, representing PG &E, referred to Mr. Addiego's <br />letter of August 9, 1983 to G. H. Huxhold of PG &E and stated that a <br />registered letter dated August 12, 1983 was sent to Mr. Addiego stating <br />that PG &E does not agree that the City has an easement over the property <br />in question for reconstruction of Seaport Boulevard. Ms. Hay stated that <br />PG &E cannot permit entry on the property or commencement of any work there <br />by the City or its contractors until an agreement can be reached between <br />the City and PG &E for the sale of the property. <br />Mr. Schricker advised that the Council may proceed with the project at <br />this time. <br />Title read.
