Item No. 4 (continued)
d. the off - street parking requirements of Sec. 30.2.2
4. The proposed use does not comply with the requirements of the Zoning
Ordinance and therefore does not qualify for the issuance of a Zoning
Permit per Sec. 44.3.
5. If the application be viewed as an application for Variance with
respect to lot width, lot area, open space and off - street parking
requirements, issuance thereof would:
a. constitute a granting of special privilege inconsistent with the
limitations upon other property within the vicinity and zone; and
b. would be contrary to the intent of the Zoning Ordinance in that a
variance would permit a more intensive land use than that permitted
on similarly situated property in the vicinity.
Moreover there are no special circumstances pertaining to the property
depriving it of privileges enjoyed by other properties similarly
situated in the Zone.
6. The property is not deprived of economic use and may continue to be
used as a single - family dwelling.
Carried unanimously by voice vote.
MINUTE ORDER NO. 83 -141
---------------------------------------------------------------------------- - - - - --
REPORTS OF BOARDS AND COMMISSIONS
None
---------------------------------------------------------------------------- - - - - --
REPORTS OF CITY MANAGER
5.
