<br />PUBLIC HEARINGS (continued) <br /> <br />Item No.1 (continued) <br /> <br />City Attorney Schricker responded to questions explaining that the term <br />"mitigation" in law refers to matters relating to the California Environmental <br />Quality Ac t (CEQA), and is not usually used with regard to financing, even if the <br />Planning Commission did include such a reference in their recommendation; that an <br />avigation easement may be granted to an airport owner to protec t his opera tions <br />and the airport users from a "taking" by overflight suits and that it has been <br />successfully upheld in courts. <br /> <br />Discussion continued and City Manager Smith, Mr. Schricker and Planning Director <br />Schroeter commented and replied to questions concerning probable sources of fill; <br />route of fill traffic; the facilities charge schedule and how it may be used; and <br />how development of housing might be accelera ted. <br /> <br />M/S: Biagi/Rhodes to accept the Planning Commission recommendation that the <br />General Plan be amended for the area known as South Shores as shown on a Revised <br />Plan submitted by South Shores, Inc. and that staff be directed to prepare the <br />necessary resolution and appropriate findings for consideration at a subsequent <br />City Council meeting. <br /> <br />AMENDMENT: Councilman Britschgi asked that the motion include that an avigation <br />easement be granted to San Carlos Airport. Councilman Biagi, with the consent of <br />his second, accepted the amendment. City Attorney Schricker advised that the <br />granting of the easement is part of the Planning Commission recommendation and <br />would be included as part of the original motion. <br /> <br />Council members commented on the reasons for their positions regarding South <br />Shores, citing the fact that plans for a considerably larger development were <br />generally approved in 1964; that lengthy seismic studies on the area are available <br />and suggest it is safe; that only half of the available land is proposed for <br />development with environmental concerns having been addressed; that ABAG has <br />designa ted the area for "infill"; that wildlife has inc reased since the <br />development of Redwood Shores; that construction of housing is necessary if the <br />problems relating to lack of it are to be solved; that jobs are essential; that a <br />variety of problems can be expected to be encountered as development proceeds, but <br />that its good for Redwood City and the community outweighs them; that the <br />development charge agreement should be extended to cover South Shores when it is <br />possible to do so; and that South Shores can be monitored as development occurs. <br /> <br />The motion carried unanimously by roll call vote. <br />(MINUTE ORDER NO. 82-60) <br /> <br />(Council recessed from 10:08 to 10:16 p.m.) <br /> <br />------------------------------------------------------------------------------------------------ <br /> <br />2.
