<br />VI <br /> <br />tt <br /> <br />ARTICLE 46 <br /> <br />PLANNED DEVELOPMENT PERMIT <br /> <br />Section 46.1 Development Permit. In any district which is also <br />included in a P- Planned Development Combining District. a planned <br />development permit may be issued for any use or structure pursuant to the <br />provisions of this article upon application by the property owner. <br /> <br />Section 46.2 Application Fee. Applications shall be filed with <br />the Planning Department by the owners of each parcel affected. Every <br />application shall be accompanied by a nonrefundable fee of Twenty Dollars <br />($20.00) plus Five Dollars ($5.00) per acre or partial acre over one and up <br />to ten acres and Two Dollars ($2.00) per acre or partial acre between ten <br />and 100 acres and One Dollar ($1.00) for each acre in excess of 100 acres. <br /> <br />Section 46.3 Development Plan. Every application <br />development permit shall be accompanied by a development <br />by a licensed architect. a registered civil engineer. or <br />land planner who is either a full or associate member of <br />Institute of Planners. <br /> <br />for a planned <br />plan prepared <br />a practi cing <br />the American <br /> <br />The development plan shall be prepared at such scale. and with such <br />number of copies. as the Planning Director determines necessary for <br />convenient review by the Commission. <br /> <br />The development plan shall contain sufficient information to establish <br />or identify the proposed uses. exact dimensions and locations to the <br />proposed structures. parking and loading facilities. pedestrian walkways. <br />and existing and proposed streets. easements and property lines. The <br />Planning Director may require such other pertinent information and drawings <br />as may be necessary to determine that the' purposes of this ordinance will be <br />secured if the application is approved. <br /> <br />Section 46.4 Commission Action. The Commission shall review each <br />application and shall recommend to the City Council that the Council approve. <br />condi tionally approve. or deny the application as the Commission finds <br />appropriate to carry out the objectives of this ordinance. The Commission <br />shall forward its recommendation. the application and pertinent data to <br />the Council. <br /> <br />Section 46.5 Council Action. Upon receipt of the application and <br />recommendation. the Council shall approve. conditionally approve or deny <br />the application as the Council finds appropriate to carry out the objectives <br />of this ordinance. The Council may. with the applicant's approval. approve <br />the plan or a portion thereof on a tentative basis and such approval will <br />not be complete until the applicant reapplies and then only to the extent <br />that he receives finàl approval on the plan or a portion thereof. No <br />additional fee shall be required for such application. The Council may <br />refer any application back to the Commission for further recommendations. <br /> <br />Section 46.6 Modifications. (a) In approving any application the <br />Council. notwithstanding any regulation otherwise applicable in the district. <br />may permit maximum heights for structures. maximum lot coverages. minimum <br />building site sizes. minimum front. side and rear yard requirements or <br />parking and loading requirements different from those which would otherwise <br />apply in the district. <br /> <br />83 <br />
