<br />(b) Notwithstanding any regulation otherwise applicable in the <br />district. after conducting a public hearing thereon. and subject to the <br />affirmative vote of not less than five Council members, uses in addition <br />to those otherwise permitted in the district shall be permitted; provided. <br />that the area subject to the planned development permit contains an area <br />of at least ten acres. <br /> <br />(c) No use permit, otherwise required by the district regulations, <br />shall be required for uses or structures permitted pursuant to an approved <br />planned development permit. <br /> <br />Section 46.7 Minimum Site Size. No planned development permit <br />shall be issued for any development unless the site subject to the <br />application contains at least one acre. . <br /> <br />Section 46.8 Public Hearing. Except as provided in Section 46.6(b), <br />no public hearing need be held on any planned development permit <br />application, provided that a public hearing may be held by the Commission <br />or Council when it deems such hearing to be desirable or necessary in the <br />public interest. Notice of any public hearing shall be given as provided <br />in Arti cle 49. <br /> <br />Section 46.9 Compliance. (a) After issuance of a permit for any <br />parcel, no use shall be established or changed or any structure constructed <br />or altered in any P District except in strict conformity with the permit <br />issued and any conditions established therein. <br /> <br />(b) After issuance of a permit for any parcel, no use shall be <br />established or changed or any structure constructed or altered in a manner <br />which would not comply with the regulations of the district except for <br />the modifications authorized by the permit, unless all development on the <br />parcel covered by the permit is in strict conformity with the permit issued <br />and all conditions thereon. <br /> <br />(c) It shall be the duty of the Building Official to insure that <br />the construction of all structures is undertaken in strict conformance <br />with the approved development plan. <br /> <br />Section 46.10 Expiration. In any case where a planned development <br />has not been used within one year from the date of granting by beginning <br />of construction of the improvements which are the subject of the permit. <br />or by the establishment of the use which is the subject of the permit, <br />the permit shall automatically terminate and be of no further effect; <br />provided, however, the Council may extend this time once for an additional <br />- year upon written request of the applicant. <br /> <br />Section 46.11 Revocation. Any planned development permit or portion <br />thereof may be revoked by the same procedure applicable to the revocation. <br />of use permits. <br /> <br />84 <br />
