<br />gð.~ <br /> <br />Chair Paulson said in order to do the conversion they could not meet their open <br />space requirements, and there was no request at the time for a variance, <br />because it was just a study session. <br /> <br />Ms. Ekas said the City Code is very restrictive about Condo Conversions, and <br />how they need to meet the minimum standards. She said a Planned <br />Development Permit doesn't allow for deviations in Open Space or Parking <br />Requirements, so it gets reviewed from two different angles: one is in the Muni <br />Code in the Subdivision Ordinance, and the other is in Article 46 of the Zoning <br />Ordinance. <br /> <br />Commissioner Claire asked that if the Planning Commission chose not to <br />eliminate the 9th unit, could a variance be granted and approved by the City <br />Council. His said his concern is increasing rather than decreasing the housing <br />stock. <br /> <br />Principal Planner Passanisi said he didn't believe that it allows for a variance. He <br />said the Planning Oevelopment Permit or Condo Permit has to conform to the <br />Zoning Ordinance, and if it doesn't, and the Commission denies this project, or <br />wishes to retain the 9th unit, they could appeal the decision to the City Council to <br />allow the retention of the 9th unit. <br /> <br />Mr. Brower said Section 30.138 of the Redwood City Municipal Code regarding <br />variances. lists several findings that the Planning Commission would have to <br />make if the Planning Commission chose to deny the project, due to the removal <br />of the 9th unit.
