<br />7)/-/ <br /> <br />REPORT <br /> <br />To the Honorable Mayor and City Council <br />From the City Manager <br /> <br />April 25, 2005 <br /> <br />Subject <br />Continued Appeal of the Zoning Administrator's approval of a Use Permit and Architectural <br />Permit at 2325 Euclid Avenue to allow for the installation of a wireless telecommunications <br />facility. . <br /> <br />Recommendation <br />That the City Council uphold the Zoning Administrator decision and deny the appeal of <br />Mary Browne and Gerald Nagel based on a review of the staff reports for the February 28 <br />and April 25 meetings, the administrative record and public testimony and find that: <br /> <br />1. The placement of the subject facilities, as conditioned by the Use Permit and <br />Architectural Permit, will meet the requirements of Redwood City Zoning Ordinance <br />Article 38, including but not limited to, operation and maintenance; height; setbacks; <br />distance; area; color; and screening. <br /> <br />2. The subject facilities will comply with the radiation requirements established by the <br />Federal Communications Commission (FCC) and that the City is preempted by <br />Federal law from regulating the placement of such facilities that comply with FCC <br />regulations related to radiation. <br /> <br />3. Conditions contained in Use Permit 62-01 and Architectural Permit 63-01 are limited <br />to Verizon, Inc. and do not extend to the subject application. <br /> <br />Further, that denial of this appeal be subject to the preparation, submission, and approval <br />by the City Council of written findings supporting denial of this appeaL Said finding shall be <br />submitted to the City Council at the next regular City Council meeting now calendared for <br />May 9,2005. <br /> <br />Background <br /> <br />At the close of the public hearing on February 28, 2005 the City Council chose to continue <br />the item to allow the church, the Alaris Group (AT&T / Cingular Wireless) and the <br />neighbors the opportunity to discuss the issues associated with the proposed wireless <br />facilities installation. On Monday, April 4, 2005 the First Congregational Church hosted a <br />community forum to discuss the proposed AT&T (Cingular Wireless) application <br />represented by The Alaris Group. Oue to the high level of concern for safety Cingular <br />Wireless has contracted Hammett &Edison to provide a second opinion on the calculations <br />and measurements of RF radiation exposure conditions. Hammett and Edison has <br />reviewed the previous study done by Oiamond Services and issued a new report. <br /> <br />Notification of the meeting was sent to the surrounding property owners within a 300 foot <br />radius. Approximately 18 people were in attendance, ten (10) of which were people from <br />the Church's Congregation and nine (9) members of the surrounding neighborhood. <br /> <br />4/25/05 <br /> <br />1 <br /> <br />"'-"-"""--""-""T"'" <br />
