1 CITY's estimated share of the construction costs required to <br />2 complete the PROJECT. In no event shall CITY's total obligation <br />3 for said costs, excluding costs referred to in Section III, <br />4 Article (11), under this agreement exceed the amount of $31,000; <br />5 provided that CITY may, at its sole discretion, in writing, <br />6 authorize a greater amount. <br />? (2) CITY's share of the construction costs including <br />8 STATE-furnished materials, signing and striping (estimated to be <br />9 $28,000), shall be the actual construction cost for the entire <br />l0 PROJECT after deducting anticipated FAU participation as <br />ll determined after completion of work and upon final accounting of <br />1R costs. <br />13 (3) To reimburse STATE for CITY's proportionate share <br />14 of the cost of maintenance and operation of said traffic control <br />15 signal system and safety lighting, such share to be an amount <br />16 equal to 33 percent of the total cost. <br />17 (4) To acquire, at CITY's sole expense, the additional <br />18 rights-of-way required for PROJECT. Said acquisition shall be <br />19 subject to review and approval by STATE. <br />20 SECTION III <br />21 IT IS MUTUALLY AGREED AS FOLLOWS: <br />22 (1) All obligations of STATE under the terms of this <br />2~ agreement are subject to the appropriation of resources by the <br />24 Legislature and the allocation of resources by the California <br />25 Transportation Commission. <br /> <br /> <br />
