<br />dates of Landlord's making of each such payment or incurring of each such cost or <br />expense, shall constitute Additional Rent payable by Tenant under this Lease and shall be <br />paid by Tenant to Landlord on demand. <br /> <br />4.10 Calculation of Pro Rata Share. Whenever a provision of this Lease imposes <br />on the Tenant an obligation to pay a pro rata or proportionate share of an expense or <br />obligation, the Tenant's pro rata or proportionate share shall be calculated by dividing the <br />approximate square footage of the Premises by the approximate rentable square footage <br />of the building on the Property, including the Premises. In the event the square footage of <br />either the Premises or Property is altered, Tenant's pro rata or proportionate share shall <br />be adjusted accordingly. <br /> <br />ARTICLE 5 USE OF THE PREMISES <br /> <br />5.1 Permitted Use. The Premises shall be used only for the purpose of operating <br />the Clinic. Tenant shall operate the Clinic and conduct activities therein in a prudent and <br />businesslike manner and in full compliance with all terms and conditions of this Lease. <br /> <br />5.2 Prohibited Uses. Tenant shall not use, or allow use of, the Premises for any <br />activity other than as the Clinic without the prior written consent of Landlord which may be <br />granted or withheld in its sole discretion. In addition, Tenant shall not permit the Premises <br />to be used for any purposes or activities which substantially increase the risk of loss or <br />damage to persons, personal property or the Property. <br /> <br />5.3 Nuisance. Tenant shall not suffer or permit the maintenance of any nuisance <br />(including obnoxious odors) on or about the Premises. <br /> <br />5.4 Solicitation of Business. The Tenant and Tenant's employees and agents <br />shall not solicit business or place any signs, handbills, coupons or flyers in the Common <br />Areas or other parts of the Property, nor shall the Tenant distribute any handbills or other <br />advertising matter to automobiles parked in adjacent parking areas without permission from <br />the Landlord. <br /> <br />5.5 Compliance with Laws. Tenant will not occupy or use the Premises, or permit <br />the Premises to be used or occupied, nor do or permit anything to be done in or on the <br />Premises, in whole or in part, for other than legal purposes, or for a purpose or in a manner <br />liable to create a public or private nuisance or to cause structural injury to the Property or <br />any part thereof, or which may make it difficult or impossible to obtain fire or other <br />insurance thereon required to be furnished by Tenant hereunder, or in violation of any <br />certificate of occupancy or evidence of compliance issued by any governmental agency <br />covering or affecting the use of the Property, or in violation of any ordinance or regulation <br />of the City. <br /> <br />5 <br /> <br />.,-".-..."..
