Ab ~c. ~o. 4-0941-C <br /> <br />immediately following Article (7). <br /> <br /> (7) If termination of this agreement is by mutual consent <br />of all parties hereto, STATE will bear 68 percent, COUNTY ;.ill <br />bear 3 percent, REDWOOD CITY will bear ]9 percent and SAN CARLOS <br />will bear 10 percent of all project related costs incurred by <br />STATE. <br /> <br /> (8) Prior to award of the construction contract for the <br />IM?ROVEMENTS, COUNTY, REDWOOD CITY or SAN CARLOS ~y terminate <br />this agreement in writing, p~ovided that whichever party requested <br />the termination shall pay STATE fo£ all project related costs <br />incurred by STATE, e~cept as provided in Section V, Article (13). <br />If both REDWOOD CITY and SAI~ CARLOS joi~tly request the <br />termi~z~i~.~ REDWOOD CITY's sha~e shall be 64 percent and SAN <br />CARLOS' share shall be 36 percent of all project related costs <br />incurred by S£,~iE If both REDWOOD CITY and COUNTY jointly <br />request the termination, EEDWOOD CITY's share shall be 88 percent <br />and COUNTY's share shall be 12 percent of all project related <br />costs incurred by STATE. If both SAN CARLOS and COUNTY jointly <br />request the termination, SAN CARLOS' share shall be 80 percent and <br />COUNTY's share shall be 20 percent of all project related costs <br />incurred by STATE. If COUNTY, REDWOOD CITY and SAN CARLOS jointly <br />request the termination, COUNTY's share shall be 8 percent, <br />REDWOOD CITY's share shall be 59 percent and SAN CARLOS' share <br />shall be 33 percent of all project related costs incurred by <br />STATE. <br /> <br /> (9) Execution of this agreement by COUNTY, REDWOOD CITY <br /> <br /> -11- <br /> <br /> <br />
