No. 4-0941-C <br /> <br /> and SAN CARLOS grants to STATE the right to enter upon <br /> COUNTY-owned, REDWOOD CITY-owned and SAN CARLOS-owned lands to <br /> construct the IMPROVEMENTS referred to herein which lie outside of <br /> STATE's right of way. <br /> <br /> (10) Should STATE incur any additional expense on behalf <br />of either COUNTY, REDWOOD CITY or SAN CARLOS ~ursuant to <br />construction of the IMPROVEMENTS referred to herein which is not <br />specifically defined under provisions set forth in zhis agreement, <br />said addition, 1 expense, if incurred on behal~ of either COUNTY, <br />REDWOOD CITY or SAN CARLOS will be borne, with their approval <br />respectively, at the sole expe~se of either COUNTY, REDWOOD CITY <br />or SAN CARLOS respectively. <br /> <br /> (11) In the construction of said work, STATE will furnish <br />a representative to perform the usual functions of a Resident <br />Engineer, a~d COUNTY, REDWOOD CITY and SAN CARLOS each may, at no <br />cost to STATE, furnish a representative, if they so desire, a~d <br />that said representatives and Resident Engineer will cooperate and <br />consult with each other, but the order of STATE's engineer shall <br />be final. <br /> <br /> (12) STATE will make all necessary arrangements with the <br />owners of public or private utilities for the protection, removal <br />and/or relocation of all utility facilities, if any, which <br />conflict with aforesaid construction and to prepare the necessary <br />Notices to Relocate and Utilities Agreements and to inspect the <br />required utility protection, removal and/or relocation work. The <br />cost of all utility protection, removal and/or relocations within <br /> <br /> -12- <br /> <br /> <br />
