· Dist. Ag~. No. 4-0941-C <br /> STATE's right of way not borne by utility owners, (except SAN <br /> CARLOS-owned and REDWOOD CITY-owned utilities), shall be shared 50 <br /> percent by COUNTY and 50 percent by REDWOOD CITY with maximum cost <br /> to each party a~ stipulated in Section II, Article (3) and Section <br /> III, Article (3) respectively. The cost of arranging for and <br /> protecting, removing and/or relocating REDWOOD CITY-owned utility <br /> facilities shall be borne by REDWOOD CITY. The cost of arranging <br /> for and protecting, rc~oving and/or relocating SAN CARLOS-owned <br /> utility facilities, shall be borne by SAN CARLOS. <br /> (13) The construction costs referred to herein are only <br /> "matching funds" based on the assumption that FAU funds and STATE <br /> funds will Be allocated for financing $2,396,000 and $886,000 <br /> respectively of the costs as shown on EXHIBIT B. In the event <br /> that FAU participation is not secured or is less than $2,396,000, <br /> this agreement may be terminated by any of the parties hereto at <br /> any time prior to the award of ~ construction contract, at no cost <br /> to either COUNTY, REDWOOD CITY or SAN CARLOS or alternately, each <br /> party's participation may be renegotiated to "make up" for the <br /> loss of FAU funds. <br /> (14) Upon completion of all work under this agreement, <br /> ownership and title to all materials, equipment and appurtenances <br /> installed within STATE's right of way will automatically be vested <br /> in the STATE; all materials, equipment and appurten~ ces installed <br /> within COUNTY's right of way will automatically be vested in <br /> COUNTY; all materials equipment and appurtenances installed within <br /> REDWOOD CITY's right of way will automatically be vested in <br /> -13- <br /> <br /> <br />
