No. 4-0941-C <br /> <br /> SECTION II <br /> <br />COUNTY AGREES: <br /> <br /> (1) To deposit with STATE within 25 days of receipt of <br />notice from STATE that the construction contract for the <br />IMPROVEMENTS has been advertised (which netice will be forwarded <br />immediately following the advertising), funds in the amount of <br />$35,000 in accordance w~th the terms and conditions of this <br />agreement. Said $35,000 represents COUNTY's estimated share of <br />the construction cost required to complete the IMPROVEMENTS as <br />shown on EXHIBIT B. Actual cost to be borne by COUNTY will be <br />determined upon completion of all work and shall be 8.41 percen~ <br />of the total n'~tch~r,g fund towards the construction cost of said <br />IMPROVEMENTS including STATE-furnished materials, ii any, and any <br />extra oz additional work directly related no the said IMPROVEMENTS. <br />In no event shall COUNTY's total obligation for construction costs <br />including contract change orders (excluding utility protection, <br />relocation and/or removal costs, if any) under this agreement <br />exceed the amount of $42,000 provided that COUNTY may, at its <br />sole discretion in writing, authorize a greater amount. <br /> <br /> (2) To deposit with STATE within 20 days of receipt of <br />billing, additional funds upon request by STATE to finance <br />contract change orders, if any, subject to the limitation set <br />forth in Section II, Article (1). STATE may defer implementation <br />of chaages requiring supplemental deposits until after said <br />deposits arc made by COUNTY except when necessary for the safety <br />of motorists and pedestrians or protection of property. <br /> <br /> --4-- <br /> <br /> <br />
