MJP:mmg 03/07/89 (#40/005) <br /> MJP:mmg /13/89R <br /> <br /> incorporated herein by reference. <br /> <br /> If, at any time during the performance of this Agreement, it <br />appears that the total cost of the sidewalk repair and tree <br />replacement services will exceed seventy thousand dollars <br />($70,000.00), City will promptly notify Ampex in writing of the <br />amount of and the reasons for such additional costs. Additional <br />expenditures by City, in excess of thirty five thousand dollars <br />($35,000.00), for the provision of services pursuant to this <br />Agreement may be authorized by motion of the City Council of <br />Redwood City. If the City Council of Redwood City does not <br />authorize such additional expenditures, City and Ampex may agree <br />in writing that City, through its Contractor, will continue to <br />provide the sidewalk repair and tree replacement services <br />pursuant to this Agreement, and that Ampex will pay one hundred <br />percent (100 percent) of the costs for such services which exceed <br />a total of seventy thousand dollars ($70,000.00). <br /> <br /> 3. BILLING AND PAYMENT PROCEDURES. <br /> <br /> A. DEPOSIT. Ampex agrees to pay to City, <br />immediately upon the execution of this Agreement, and before the <br />commencement of any work by City or Contractor pursuant to this <br />Agreement, thirty three thousand two hundred and sixty two <br />dollars and fifty cents ($33,262.50), which will be applied by <br />City toward Ampex's share of the costs of sidewalk repair and <br />tree replacement services pursuant to this Agreement. <br /> <br /> If, after the completion of all work performed pursuant <br />to this Agreement, Ampex's share of the total costs for services <br /> <br /> 3 <br /> <br /> <br />
