,STATEMENT OF AGREEMENT ORIGINAL For Joint Exercise of Powers of BaN Area Wate~ Agency' THIS AGREEMENT dated for convenience March 1., lg~9_, made and entered into by and between political subdivisions of the State of California, municipal corporations and public corporations located in the Counties of Alameda, San Mateo and Santa Clara, and other Bay Area counties who, either before or after this date became siqnatories hereto; WHEREAS, public purposes are served by the establishment of a joint powers' agency of political subdivisions of the State, municipal corporations and public corporations to provide for investigation, study, planning, and neqotiation relating to securing water sources and relating to charges for wholesale supplies of water, and to facilitate joint representation of the parties hereto in relation to the resolution of such matters; and WHEREAS, the parties by forming a new agency, wish to state their Agreement for the Joint Exercise of Powers By Bay Area Water Agency; and, WHEREAS, Title I, Division 7, Chapter 5 of the Government Code of the State of California, comprising Sections 6500 throuqh 6519 thereof, authorizes the joint exercise, by two or more public agencies, of any power common to them; and WHEREAS, the parties hereto possess the common power to acquire, store and distribute water, to provide for solution of tuch problems which are of direct concern to the parties hereto in the performance of their constitutional and statutory functions, and to join associations and expend public funds for such purposes, including funds contributed by the parties or by any person or any subventions or grants which may be obtained from the Federal and/or State Government; NOW, THEREFORE, in consideration of the mutual terms, covenants and conditions herein uuntained, said parties, acting by and through their respective legislative and governing bodies, do hereby agree to the joint exercise of powers, as follows: 1. PURPOSE OF AAREEMENT: The purpose of this agreement shall be to provide for the participation by City of Redwood City as a member of Bay Area Water Agency (~erei'nafte'r referred to as the Agency), a separate public entity. - i -
